PLEASE HELP! scammed by dhgate.com/paypal

Hi, any help that could be provided would be greatly appreciated.

My sister bought a macbook off dhgate.com for $2000AUD, the package arrived yesterday and is full of bricks and foam. We opened a dispute with paypal and dhgate.com (dhgate.com claims to use escrow).

She escalated the paypal claim and it was automatically rejected by paypal claiming that the paypal buyer protection only covers undelivered goods, not item quality. The paypal policies claim that item quality is only covered by purchases on ebay.

My question is:
Is there anything at all I can do?? It's killing me, my sister is so upset she worked really hard for that cash. I don't care how illegal the method is, I need to help her.

All payments where made on this computer with the same ip.

Shit that really sucks.... sounds more like you need to go to the local police aswell and someone did mention a site before that paypal listens to if you make a complaint with them and they follow it up.

claim as not as described

check the description of the product if its the same with the macbook you received
 
yeh thats bad man. real bad. if i was you id get on the phone to paypal now and say all the above. demand to talk to sum1 higher up than a shitty customer service rep they have. you will get through to sum1 eventually. take this up and mention everything about it. it may help out if you do rig them though
 
You should probably double check the item description, with a lot of things like this the descriptions are cleverly worded.. or forgets a few things.. If the description is for a genuin product then take it up with Trading Standards (if your in the UK, or your none-UK equivilant) and the local police. Once the police get involved PayPal should budge.
 
Urrrm just had an idea... you could allways use the 'porn paypal' method to get the sellers paypal account banned if you don't get anywere.
However a simple google search for 'company name scam?' will pull up loads of info about the company and their scams etc... but none so far as bad as yours that i found.

Your best bet is to go after DHGate and put pressure on them. Your first attempt should be to send them a nice professional email and as you know that will not work but then send them a second email telling them that the issue has not been resulted and unfortunately you are forced to take other actions. What I like to do when a company gives me trouble is post how bad the experience was on related forums and affiliate networks (In this case ShareASale) then give them the links in a email and tell them that you will continue until the issue is resolved.
 
If the paypal is backed by a credit card then file a dispute with the CC company (chargeback).. Also, check out consumerist.com as they may have an EECB list (Executive Email Carpet Bomb).

If you have photos, etc. I'm pretty sure that popken at consumerist will build a story and make dhgate very sorry they messed with your Sis
 
Call your bank now! I bet you had that kind of money withdraw`d from your cc. Call your bank and tell them you want to cancel the last purchase. All cc have buyer protection. Even debit cards (if they are VISA). It will f*ck up your paypal account but you can always open another. Oh, and..DO IT NOW!

The money came straight out of her bank, as soon as the paypal service line is open we'll call them. She claimed 'not as described' in paypal but apparently this only covers ebay items, here is the email my sister got as a reply for escalating the dispute:

Dear *****,

You have chosen to escalate your dispute to a PayPal claim. By ending
communication with the seller, you are asking PayPal to investigate the
case and decide the outcome. As part of our investigation, PayPal reviewed
any communication you may have had in the Resolution Centre.

Our investigation into the following transaction is complete. As stated in
our User Agreement, the claims process only applies to the delivery of
goods. It does not apply to complaints about the attributes or quality of
goods received. Therefore, we are unable to reverse this transaction or
issue a refund.

We are also going to try and return it via registered mail (we have a dhgate dispute open), my sister found info on dhgate:

The received item isn't what you expected

1. If a buyer is not satisfied with the received item and likes to get full refund, he should return the item and provide us with tracking number within 5 business days after the dispute is submitted to DHgate. Once the seller and DHgate confirm the delivery of the returned item, refund will be arranged. It's buyer's responsibility to pay all the incurred shipping fees and custom duties, if any. The seller is responsible for all custom duties incurred at the seller's country.

2. Both buyer and seller are required to supply proof and copies of shipping document within 5 business days after a dispute has been submitted. DHgate will make a decision 10 business days after all the evidence is received.

I hope this works, we will get the police involved tomorrow as well.

Contacting the police won't do anything. If you didn't pay via a CC, then I don't mean to sound negative but you probably have been screwed. I find it amazing that DHGate would actually send you a box of bricks...
 
Dude...that sucks balls..

I have actually dealt with the same kinda thing before...but I got my product from DHGate..

I bought 10 pairs of $20/each sunglasses, and 3 of the pairs were fucked up... they didn't do shit!!... they offered me $10 back..

DHGate is risky... you gotta know how to use it

Your local Trading Standards Officer would be a good start
You ordered a macbook not a brick
Tell dhgate you well return it to them as they sent the incorrect product.
 
I may be missing something, but DHGate appears to be a marketplace for people from China? The laptop was shipped to Australia. Getting in touch with the local police in Australia for a $2k scam from China probably won't get very far.
 
Contact Paypal by phone and tell them the situation. Be specific in telling them you got a box of bricks and foam, NOT the item you paid for, which is not a loophole for their " item quality " bs. Tell them that you never received the computer you paid for, therefore, it is an undelivered item. Whoever told you that it was an item quality issue needs to be reported to paypal and fired, which they can check your records and do.

Call someone, a real person and tell them that you need to file the complaint and want your money back. I've had to deal with this issue in the past and is one of the MAIN reasons for my creating a competitive service that will be released to the public soon, blowing these cons out of the water.

why not just say you dfidnt recieve the good at all?
say you have desputed with the compnay but not getting any response, hence why you approched the bank!

or, just say you didnt do the transaction at all to ur bank.. ( yes blackhat, illegal an al sorts) your bank should cover you for unauthorised transactions!
 
As sad as this is is, there will be nothing you can do unless you paid thru Paypal with a credit card and in that case you have to go through your CC company.
