PayPal negative $9800 advise

It is not your money, you should refund paypal. It is not paypal's fault that your merchandise got damaged.
For this amount paypal will start sending you email(s) and sms, if the debt is not paid then the debt collector letters will start coming to your address and after a year or so, you will get a court order.
 
if it is a stealth account no problem, just forget of it. in the other case you may find credit collectors on your home
 
i had this when i was under 18, called them and explained that im under 18 and they closed the account and balance without any issues
 
Thank you again for all the replies. I’ve just walked away from this….. right or wrong not here for a moral debate. I’m just curious what the ends will be. None of the info PayPal had from my phone number to address to even an open bank account is at all accurate any longer. ‍♂️
 
Not even on a moral level but if they sell of the debt some debt collectors can get your wages garnished if you have a job. So that's something that you may have to go through in the next year or two. It usually takes a long time before this happens.

Your car insurance didn't cover the damaged goods? If you were lucky and the accident was someone else's fault, their insurance should cover everything. Were you selling fragile items that were easy to break, did your car explode? Lots of questions.

Some years ago I had an issue. I was selling a service, couldn't fulfill, spent a good chunk of change trying to fulfill, didn't work out. I ended up taking a big loss but I did cover it all immediately from my end. Got eBay selling shut down, still allowed to buy, even though I made everything right from the beginning with immediate refunds (tons of them), big losses on my end. To this day none of my eBay accounts can sell anything. I still have PayPal although my main account was shut down for selling something against TOS (separate incident). I always immediately made things right so no experience on the collections end of things.
 
Unfortunately the accident was my wife fault. So insurance was giving us hell to get the vehicle fixed at all. I’m in Texas and the law will not allow wage garnishments for debts except child support. So they cannot garnish my wages. ‍♂️ And wow, that’s horrible they still banned you even though you made it all square.

Nothing yet. I wouldn’t expect to hear anything till years end. Maybe a debt collector. I have checked with the law though. Texas seems to be a great place for this. They cannot garnish my wages or take my home or card anything in the home even (up to 100k). I sorta feel bad for the collection agency that buys this out and spends the money on the case. In the end they won’t get anything

It's probably in your interest to cut a deal. Either with PP or the debt collection they sell the debt too.

It doesn't go away til its paid, although you can technically get out of really paying them anything no bank or loan facility will touch you with an outstanding default for that amount. Although i'm not sure of the law in Texas i know most states have a period of X amount of years after a default is cleared til it's wiped off your file. If you don't clear it, it essentially just sits on your file indefinitely.

You could essentially be fucking yourself for a very long time.
 
9800$ is not a small amount.
So they will go bad to look for you.
They will try to connect with all info related to your account, and look for you to wipe your ass when you are doing shit so better move to a location and hide your ass.

Here are your options the realest ones!

Option 1 ( if you can't afford hole 10k )

I do practice law but in europe and my main line is criminal law but.

guys already told you that this debt will be sold to some agency that will try to collect money from you, but before that even happens here is what you can do.

Talk to Paypal, wait for their call and explain that you cannot pay and that's it, then negotiate but be careful since they will be recording phone calls, so don't lie nor don't play smart. Maybe you can talk this down to 5-6k and if so then pay them, you can also stretch the payment schedule like for a year, divide so you can pay some amount every month.

If they deny your offer, let them sell this to an agency, either they will directly sue you or will try to negotiate, anyways 5-6k after you explain should be decent amount for both you parties.

If you go to court with this case, whoever tells you whatever you will lose this case 99.99%, because as you mentioned everything is under your name so no need to talk bullshit or even think so, you will need lawyer and etc.

OPTION 2
Just give paypal their money, because it's THEIR MONEY.

OPTION 3
Negotiate to split payments for example every month.

Now if you will play gangster and this is texas baby.


1. If Paypal decides that you scammed them for 10k they can also take this matter to authorities and you will still need couple of grand for a lawyer in best case scenario. ( most likely this will not happen though )

2. Believe me whatever law that you read or whatever research you did, I don't need to look in codes of Texas to tell you, that hustle and problems you will get for this 10k will not be worth, like it or not they will come after you assets and they will bother you a lot, especially when business was under your name not LLC.


If you can afford to pay, save some trouble and just pay them. 10k is not small amount of cash.


Wtf guys, it's 10k not 100-500$ when they simply don't bother to proceed with law suits, because resource they have to put is not simply worth of it, who ever is telling him to just forget it, would you be doing the same or would you advice this to someone close to you?! Besides he is in US, so he is not going to be that hard to find.

I recently had a case where my client didn't sign a document that would indicate whatever assets he had and this came from collective agency. It turned into criminal case real fast, eventually had to talk to prosecutors and they dropped charges, just because it was his first time and explained it as "misunderstanding" between parties, but some are not that lucky.

Believe me you guys have no clue how technical this things can be, so do not advice him to just walk it off.

I logged into PayPal to see about contacting them for a payment plan. The debt shows 16k. That doesn’t even make sense. It should have been about 10.8. Then when I tried to contact them the machine stated it was already turned over to a partner. And the wait time was over an hour to speak……..
