PAYPAL Chargeback - I've proof - what next?

I am from India and I worked with a US guy 4 months ago on a JV and he had sent some money via paypal in phases. I have all the proof of the money spent for business and he acknowledged that.. He then decided not to invest further citing personal reasons and asked me to shut down the JV and sell off all assets and send the money. Before sending money, I asked him to sign an agreement that clearly stated there are no dues from my end to be paid and all payments he made via paypal were authorized and fulfilled. He signed it and sent me the document after which I sent him the payment I received from selling the items off. He then cleverly opened a chargeback on paypal saying he didn't authorize payment and paypal has put my account balance in negative.

I uploaded proof and the agreement we had and paypal does nothing about it and he is now on a chargeback spree (chargingback all payments he made)..I am contemplating of taking legal action against him because he is clearly going against the rules of business. Anyone to offer suggestions on what I must do from here on?

One thing's for sure. I am not going to pay a dime to Paypal or to that fraud.. I called up Paypal and reported this issue and the CSR told they cannot stop a buyer from claiming chargebacks with his/her credit card company, but how the hell can credit card company refund to him without verifying if he is simply scamming someone out of it?

I wish I could give you better news but in most cases your screwed just call paypal

When i say call I mean CALL

They can do more over the phone then over the message board
 
I hear where you are coming from but PP is a 'Crock of Shit' and I fear the odds are not in your favor - even though you have the paperwork to back up your case!

If I was in your position I would call out PP everywhere publicly on this issue as the downside for you is that you have nothing more to lose.

How can a chargeback come after 4 months? Only 30-45 days is permitted if i dont forget.

You have 45 days to open PayPal dispute.
But you can file a chargeback within a 6 months after the transaction was made (usually). Once I had a chargeback after 8 monhs after the sale was made, lol! I called PayPal and they said it all depends on credit card company policy.

I lost an account with $16,000 in it from a 4 month old charge back for a vacation rental. The people spent the time in the vacation rental and enjoyed it. The air quit working on the last nite at 4 am before a 11 am check out. They charged back and Prey Pal refunded the entire vacation rental to them. And closed my account that had not had a problem in 6 years. Over a year later they refunded the money by check to me but closed the account and wrote a nasty note to my bank trying to cause problems. My bank told them off and they closed five accounts at that bank I had nothing to do with. I did not even know they existed. They did not belong to me. The bank will no longer deal with them.

So yes they can and do cause real problems. Wish their was a legitimate alternative.
 
keep us updated.... this is serious shit!!! thats why i try to avoid dealing with paypal as much as I can.....

what happen if u just forget about that account and keep it negative?
 
Really sorry to hear that but unfortunately you are likely out of luck. When PayPal receives a chargeback from a credit card company they too are on the hook for the money, which is why the immediately put your accounts balance on hold while the chargeback has taken place. The problem is with Paypal but also with the credit card industry and how Paypal acts as the intermediary with the credit card companies. My feeling is that Paypal and the credit card companies don't work well together. Everytime I've ever had a chargeback from someone through paypal using a credit card I have lost. Once client wrote email after email about how amazing my service, then they did a chargeback months later on six months of service. Even though I had everything documented, and had proof the the client UPGRADED his service with us after being so happy we still lost. On another chargeback I had, which wasn't paid through credit card via paypal but via a paypal balance, we won. When it's a paypal balance, and not a credit card, you probably could have won. Since you are dealing with the credit card company via Payppal you are likely screwed.

My recommendation, is try and get in touch with the credit card company. I don't even know if this is possible, but its worth a shot. Get someone on the phone there and pass along as much info as possible, they may review it and then close the chargeback. Otherwise you are out of luck.
 
Happens quite regularly mate. We had a couple of chargebacks in the earlier days of business too. Moved a portion of business to 2CO thanks to this.
But like someone said above, there's not much you can do on this. PayPal will always be on the other side. Calling may help. Try it, but don't have high hopes!
 
This is insane!! i mean PayPal is used by most people and exactly whats next now?? keep updating us mate!
 
Unfortunately this is the case with paypal and chargebacks.They dont protect you against chargebacks.Anyone who pays with credit card through paypal can fill a chargeback after months and in most cases it is decided in buyers favor.Even though you have signed documents to back up your story its pretty tough to win this case.
Call paypal and if the amount that is claimed is big and worth it then get an attorney.Go public.
