Nah, just a "concerned citizen" like yourself. I prefer to sue instead of pre-suit settlement negotiations, but everyone has a strategy. I probably get higher settlements, but it takes a bit more time. Typically 3-6 months, but sometimes a year or more.

Just one thing I have seen appeals courts reject is stacking multiple violations. The most I have seen is 3k per call for a violation of 47 USC 227(b) and 47 USC 227(c)(5) through 47 CFR 64.1200(d) that you mentioned. For example, it is a violation to make an automated call to a cell phone and a violation to use a pre-recorded message, but you can only have one recovery under 47 USC 227(b) for a max of 1500.

Oh interesting. I've been out of the game for a long time so I'm sure a lot has changed since then.
 
Yeah, the FCC just released a ruling a few months back and there are a couple of supreme court cases that will probably get decided in 2016 that may change things a bit, particularly for the class action folks.
 
cant help not being pissed off while reading this, being a telemarketer myself, im sure some people break some laws and they kind off deserve this. what if its a newbie just trying to earn an honest buck??

I'm unable to pm you, first I would like to say awesome idea, I have a few questions, I live in Florida where it is required for both parties to consent to recording, Does that mean I need to interrupt them and say "do you consent to me recording our conversation as well"??? Also what method do you use to record your phone calls, what kind of device, and are there devices that are not approved for recording???

You give them your address?
or you just tell them you expect your check in the mail?
 
I used to work in telemarketing. Not the best job but it paid the bills. We did have a way to put people on the Do Not call list but it would take weeks for it to update in the system.

You sign a Settlement Agreement and Release with a confidentiality clause. I had my own created and informed the opposing party or Attorney for the party that I would have it drafted, executed and sent to them. They would in turn execute and forward back along with the settlement check via FedEx. So yes, they have your address and probably every bit of info on you considering you're threatening suit against them.

It's not an honest buck, if you are breaking the law...

If they give the "calls may be recorded..."disclaimer, that most companies give, that is 2 party notification and you can record away. I have a smart phone and an app. I don't use tapes or any of that stuff anymore, neither should you.
 
If you spent just as much time building a real business instead of trying to tear someone else's business apart maybe you would actually be able to make some real money. Doing this is worse than the telemarketing.

I've been there and done that too. No reason I can't do both. If the person's business was legit, they wouldn't be robocalling and getting sued by me. Don't hate the player, hate the game.
 
I knew someday I would regret not moving to the States when I had the chance. But that is one sick exploit. Remind me to NEVER call you if I'm into telemarketing. Thanks.

That's a good method of offline marketing.But I always like to prefer online marketing because it is faster and efficient without much hard work. It is beneficial for me.
 
This still works. Been at it since late September and have gotten almost $16,000 in settlements so far. Probably the easiest money I've ever made

Some tips:
You DO want to be on the Do Not Call list. This way you can ask for $1500 instead of $500 per call
This can be applied to texts
