Hi, I need some help with the consumers law in the USA. I am familiar with the Australian Consumers Legislation and I am particularly interesting in returns. By law in Australia if a product is not fit for sale and is not of appropriate durability the customer has the right to a refund. I was wondering if this is the case i the USA?
 
Really? I was hoping that wasn't the case. In Australia TOS don't mean shit if they don't comply with the ACL.
 
Depends.

If it is a digital product, you are pretty much stuck. If it is a tangible product, then it must be fit for the purpose of which it was advertized.
 
It is a tangible product that stopped working after 2 weeks. The supplier only offers replacments but I am sure they have to offer money back if that's what the customer wants?
