Mobile Proxy Resellers – Contracts & Liability | UK

I’m looking into starting a mobile proxy end-user / reseller service and I want to understand the legal side, mainly for the UK.

What kind of terms or contracts do you use with end users to protect yourself if a client does something illegal using the proxies? How is liability usually handled under UK law so the provider is covered?

Hw are you handling GDPR for mobile proxy services? Are IPs and usage logs treated as personal data, and do you run full GDPR compliance (privacy policy, retention, ICO, etc.)?

The provider won’t let end users do something illegal anyway. Ports, protocols, destinations and abuse vectors are usually restricted by default, so a lot of illegal use is blocked before it even happens.

On the legal side, it usually comes down to how you position yourself. In standard reseller agreements you’re clearly defined as an intermediary between the supplier (proxy agent) and the end user. In that case, GDPR obligations and most compliance questions sit on the provider, not on you. If instead you run a public offer where you present yourself as the sole provider and don’t disclose that you’re a reseller, then yes - you take on much more responsibility, including GDPR.

For beginners the safest and simplest option is to be transparent. State in your offer and privacy policy that you are a reseller/intermediary. That alone removes a big part of the legal and compliance risk and makes things much easier to manage early on.
