Any form of hacking could land a criminal prosecution, it depends how serious it is, and/or which companies/people you decide you want to hack lol.

I don't think he's talking about hacking. I think he used the wrong word. Pretty sure he's talking about downloading copyright stuff. I guess it kind of depends. But in reality, people are downloading copyright shit (movies, music, etc) everyday. If you got caught, you'd have to be on unlucky sucker!
