How to sue programmer?

Somebody is stealing ther project manager name and photo they said. Lol clearly that's his account, the profile photo both are the same person. Just different picture.
Could he have stolen the photos from that person's social media account? Unless you've had a live video chat or an in-person meeting, there's really no way to "prove" that any of the photos are his real picture.

No. His first account just work as project manager for the company.
So it have none work hours, jobs, and success rate.

The second account, is his own personal account for doing the freelancer work I suppose.

Why on earth he want to create fake account, and then work hard to build the portfolio?
With thousand of work hours, reviews, cash earned, etc

This is not fiverr or seoclerk btw
 
Your issue is the main reason that when I farm out programming/coding that I use more than one person and each has their own aspect of the finished product.

It is almost impossible to hold you up like that when you do that nor does it make any sense for the coder to sell your product.

How would you have different teams/people working on different aspects? Example - begining - hand off middle then finish?

Let's say you want to build a tool that can create accounts, post on certain platforms and then have the accounts interact.

You have one guy build the create accounts module, another create the post module and the third the account interaction module.

That is a pretty simple example but in general the stuff I build for internal use all have module aspects and that is how I usually handle that sort of thing unless I am teaming with a coder/programmer and then the entire project is in his hands and we may farm out some aspects or he will build the whole thing.

OP, I have a pretty well-established Upwork profile ($15k spent, 5 stars). If you want I can invite him to a project, get him interested, then before hiring let him know I was referred to him by you, that we are close friends, and I want to start my project in 6 months. It's not much, but it's 6 months where he will behave in order to get more business, and you can look into a more sustainable method if you're really worried about him going rogue.

Same thing i've done with a product i had made. I had multiple company's to build bits of the product. And i assembled it my self.
 
Oh - just read page 2. So he might be faking his name/profile photo? Something I've noticed too a lot on Upwork, especially people from Balkan countries.

Have you had a voice-call with him? Does he sound Russian? Has he ever forgotten to switch to ENG-keyboard and wrote Cyrillic? Does he write smileys like this )))

If he's been forging his name and all, your NDA won't mean shit. That's why photo ID (or actually meet up) is so damn important these days.
 
im sure if you hired them through proper channels then you can seek legal council
 
I paid 1 programmer from Ukraine.
Everything was perfect. The project was 98% complete.
Out of sudden I think this programmer is tying to bullshting me.
Keep asking to borrow money from me. Because he need to pay money to his friend.
His wife asking him to buy a car and stuff.

So what does it matter to me?

I dont want this problem, so I just cancel the project, move into another programmer.
Even though I already paid him full + extra.
He even own me few K, yet I just said to him no need to pay then.

And now he threat me, that he will sell my code to my competitors.

I'm asking him why?

Its because I stop hiring him lol. Wtf I already paid him full + extra cash.

He already sign the NDA btw.

I got his photo, upwork profile etc

But how can I make sure he won't selling my code to my competitor?

And what are the best way to secure my project in term of law?

I've been through all this, and I've spent over 800k on Upwork to date.

You just hit up live chat and explain everything you just said here.

If everything is within the Upwork chat stream, they will review it themselves, if he said stuff outside of Upwork, on Skype, via emails etc. just take screenshots and attach them to the ticket.

Chances are they will suspend him or bounce his ass, or freeze the money and you got a chance to get it back.

Try to recover all the money you paid, simply because he think you are a fool.
And no mercy for this kind of people
I remember when I opened a paypal dispute for $10 to an indian guy
 
@PinguSpy I was really astonished someone smart like you getting scammed and prepared an angry reply, but after reading the whole thread, there is actually nothing to say. You have done your best and its definitely a pretty weird scenario. The main question, How much does his upwork profile worth? If less than the amount paid then your hands are cuffed as he is ready to lose his account for blackmailing you. I would never give anyone money unless his profile worth A LOT more than what I am paying.

If his account worth more which I think it's from the stats you mentioned, then, he thought he will get away with it and pushing through upwork should get things solved. Anyway, I believe you can find another programmer, but your focus should be getting you money back. So, contacting Upwork was the right step. Not sure if threatening him with legal action will make him step back or know how much you value the code and try to squeeze you more and more.

You are definitely in a hard situation , but look at the bright side, you are one of the brightest members I have ever seen in BHW, so, no matter what happens you will always have tons of other bigger and better ideas. It's only small part and not a total loss.

IF I had paid that big amount, I would not hire a lawyer to fix the problem. :smirk:

I have worked with devs from India, Egypt, Philippines, Indonesia, UAE, and Ukraine. Ukraine is by far the best place to hire developers in my opinion, so completely agree there. I will always prefer to work with devs from the Ukraine, and never again from India.
