    I've been selling Chinese cell phones on Ebay for about a year, but I'm sort of out of it now. Too much hassle . Some dickless Fucking tool "competition I suspect" Was asking me about what stickers were on the phone. ie compliance. I stupidly answered honestly and a couple of weeks later I just got this in my Inbox. I don't really give a shit , but would if I were still in the Biz, I'm also glad its not linked to my Powerseller store :eek:
    Be careful peoples

    Unlabelled / Non-Compliant Products
    The Australian Communications and Media Authority (the ACMA) has received information suggesting youmay be supplying telecommunications device(s)to the Australian market that may be unlabelled and non-compliant in accordance with the applicable labelling notice(s).
    Regulatory Arrangements
    The ACMA is the government agency responsible for the regulation of broadcasting, the internet, radiocommunications and telecommunications.

    These regulatory requirements are described in the following legislation and legislative instruments:
    • Part 21 of the Telecommunications Act 1997 (Cth) (the Telco Act);
    • Part 4.1 of the Radiocommunications Act 1992 (Cth) (the Radcoms Act);
    • Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice 2001 (the TLN);
    • Radiocommunications (Compliance Labelling ? Incidental Emissions) Notice 2001;
    • Radiocommunications (Compliance Labelling ? Electromagnetic Radiation) Notice 2003; and
    • Radiocommunications (Electromagnetic Compatibility) Amendment Notice No.1 of 2009.
    For your reference, I have attached links for the following brochures to assist your understanding and compliance with the regulatory requirements applicable in Australia.
    • Telecommunications Labelling and Compliance (August 2005)
    • Radiocommunications Standards Compliance and Labelling (June 2006)
    • Electromagnetic Compatibility, Compliance and Labelling (September 2008)
    • Fact Sheet 60: Labelling of telecommunications customer equipment and cabling.
    Further information on these arrangements is available on our website at:
    http://www.acma.gov.au/WEB/STANDARD/pc=PC_2754.
    These above arrangements require compliance with the specified mandatory standards, labelling the device with the compliance mark and the collection and maintenance of compliance documentation by the supplier/manufacturer/importer/authorised agent.
    For clarification, the ACMA?s view is that an importer is the person who organises the importation of devices, including over the internet for shipment from an overseas distributor to a recipient in Australia.
    Information received
    Details of the information received by the ACMA are provided below.

    The ACMA has been informed that you have been advertising for sale, via the eBay site """"EDIT OUT"""""
    ?"""""EDIT OUT"""""?that does not appear to be compliant with the applicable labelling notice(s).

    The purpose of this letter is to alert you to the information received by the ACMA and to make you aware of your compliance obligations.
    The ACMA does not intend to take this matter further, at this time.
    Please ensure that all products supplied by you are compliant with the relevant regulatory requirements applicable in Australia, and that the appropriate compliance documentation is maintained.
    If you require further information please contact me on (03) 9963 6719, via email on """"EDIT""""or at the postal address above.

    Yours sincerely

    I,m trying to ignore it. But it really pisses me of that you can't make a few quick bucks on an Auction site without the fucking man trying to bring you down. I'm recalcitrant and i'm sick of this sort of control shit. I just feel like packing up and finding a nice peacefull island somewhere, make coconut rum all day and bang the local honeys.

    There are to many mistakes in that email - I had emails via ebay saying I was selling a website template from a certian website, I infact made the template myself so I asked for evidence as I would be report the "site" I was supposed to have stolen !

    I never got anything back from the person and soon after the account was closed - Its just competition trying to scare you off!

    Ebay is just a scumbag place to make money from - On the other hand I hate people who sell dodgy stuff from China claiming its real http://business.timesonline.co.uk/tol/business/industry_sectors/consumer_goods/article2886656.ece

    Its not right in my opinion - Im not saying your selling dodgy stuff but they were fake by the sounds of it and could put risk to life - Thats wrong

    I find it hard to believe that a government would email you about an infraction such as this. Email is too unreliable and the gov't generally likes to "inform" you via postal mail to make it all "legal" and more official.

    But I don't know how YOUR gov't actually does things. So I guess it's always possible ... but I doubt it. ;)

    Life is FUN on the Net - huh?

    That's fake IMO, but since you're selling china stuff and claim them as real, I can imagine many people pissed off, so If I were you I would confirm this email to the ACMA myself!!!

    P.S. Usually the government doesn't send emails, but cops in your door:D

    I was upset too, they pulled the plug on my auction when i tried to get rid of the mother in law :) Anyway, I don't see where in your email it says anything about them taking action, so put on your blackhat baby and keep on rolling.

    I do not think so .... I have just read an ad of a European importer of phones .... he stated that the phones do not have CE (which is European compliance) and certificate of compliance can only be obtained when ordering more than 2000 pcs.

    Selling phones, electrical devices etc. in the EC without CE is not allowed and will draw legal consequences ...

    I agree with everyone else, seems very fake. I would have thought if it were the gov't that you would get a letter through the mail, not an e-mail.

    Australia has been a bit wacked out lately regarding the creation of new consumer protection laws. Not sure what they are in drinking in their water but they have taken a strong turn toward consumer protectionism. I'm not sure about the politics involved.

    Wake up dude - since when in Australia do the Gov serve you will an email?

    NEVER...

    You will be served in notice by a cease and desist letter. Take no notice until you get that.
    Also look at the header of the email and see where it is really from...

    China puts "CE" on everything even if it is not compliant, he doesn't have to worry about compliance every government in the world loves electronics made in China
