I've been selling Chinese cell phones on Ebay for about a year, but I'm sort of out of it now. Too much hassle . Some dickless Fucking tool "competition I suspect" Was asking me about what stickers were on the phone. ie compliance. I stupidly answered honestly and a couple of weeks later I just got this in my Inbox. I don't really give a shit , but would if I were still in the Biz, I'm also glad its not linked to my Powerseller store

Unlabelled / Non-Compliant Products
The Australian Communications and Media Authority (the ACMA) has received information suggesting youmay be supplying telecommunications device(s)to the Australian market that may be unlabelled and non-compliant in accordance with the applicable labelling notice(s).
Regulatory Arrangements
The ACMA is the government agency responsible for the regulation of broadcasting, the internet, radiocommunications and telecommunications.

These regulatory requirements are described in the following legislation and legislative instruments:

• Part 21 of the Telecommunications Act 1997 (Cth) (the Telco Act);
• Part 4.1 of the Radiocommunications Act 1992 (Cth) (the Radcoms Act);
• Telecommunications Labelling (Customer Equipment and Customer Cabling) Notice 2001 (the TLN);
• Radiocommunications (Compliance Labelling ? Incidental Emissions) Notice 2001;
• Radiocommunications (Compliance Labelling ? Electromagnetic Radiation) Notice 2003; and
• Radiocommunications (Electromagnetic Compatibility) Amendment Notice No.1 of 2009.

These above arrangements require compliance with the specified mandatory standards, labelling the device with the compliance mark and the collection and maintenance of compliance documentation by the supplier/manufacturer/importer/authorised agent.
For clarification, the ACMA?s view is that an importer is the person who organises the importation of devices, including over the internet for shipment from an overseas distributor to a recipient in Australia.

I,m trying to ignore it. But it really pisses me of that you can't make a few quick bucks on an Auction site without the fucking man trying to bring you down. There are to many mistakes in that email - I had emails via ebay saying I was selling a website template from a certian website, I infact made the template myself so I asked for evidence as I would be report the "site" I was supposed to have stolen !

I never got anything back from the person and soon after the account was closed - Its just competition trying to scare you off!

I find it hard to believe that a government would email you about an infraction such as this. Email is too unreliable and the gov't generally likes to "inform" you via postal mail to make it all "legal" and more official.

But I don't know how YOUR gov't actually does things. So I guess it's always possible ... but I doubt it.

I do not think so .... I have just read an ad of a European importer of phones .... he stated that the phones do not have CE (which is European compliance) and certificate of compliance can only be obtained when ordering more than 2000 pcs.

Selling phones, electrical devices etc. in the EC without CE is not allowed and will draw legal consequences ...

Australia has been a bit wacked out lately regarding the creation of new consumer protection laws. Not sure what they are in drinking in their water but they have taken a strong turn toward consumer protectionism. I'm not sure about the politics involved.

NEVER...

You will be served in notice by a cease and desist letter. Take no notice until you get that.
Also look at the header of the email and see where it is really from...
