I am not really sure what the question is but guest posting must not have any copyright issues. Of course, the post should be credited to the guest writer.

Do you mean duplicate content? If you use the same article on both sites, then yes, google will see it as duplicate content.
If you mean copyright content, Google does not really care who owns the copyright unless someone complains to them about it, but the copyright holder is much more likely to complain to you directly or your web host.

The important thing to be aware of is the domain authority of the site you first posted the guest post on,
if another site comes along, and uses the same content, then there is nothing you can really do, that site is
probably just overall a bunch of crap. There are a few forums that scrape bhw, and are all duplicate content
and they don't rank anywhere, but bhw still ranks top.
