Good guy turned bad!! Scammed

If I could remove that black mark on his PP I would. I tried to open the dispute and it was closed instantly by paypal because it had elapsed 45 days. I have even been back to my PP today to see if I could remove this "Blackmark" for him but theres no option to remove or close a closed dispute.
I just want the 66% of the $90 I paid him back. I make that $59!! as he did not deliver the service i paid for.
I started out thinking this started as a mistake but since creating this thread I have realised he knew what he was sending me it looks like a theme or something that he has renamed to "articles-2.zip" there's no mistake there he renamed it to part two of the outstanding articles. How can you mix that up?? if it was a mistake it would of been articles.zip i mean how many of his customers does he deliver the articles in 2 parts!!
