I don't understand one thing. You are a professional writer and you said you had his emails and chat logs and yet you did not keep a copy of the article you sent to him? As you are professional, you should know better. Not keeping a copy of the article just does not make sense to me. This whole thing could have been avoided just by doing that. This is unpleasent for everybody regardless whoever is at fault here.

I already admitted that this part of it was a lesson learned by me.

I was willing to simply walk away, him without part of his order, so he says, and me with the black mark on my paypal.

Uh TenureFP, if you have 'all the emails' then you have the one that has the article attachment - and can verify that it does or does not include the 2nd batch. If it doesn't, then what you sent was... uh... corrupt... or is that the only email that you don't have archived?
 
Upload a sceenshot or video to prove that he send u a empty file with his legit e mail address showing
 
TensureFP... I've been in the content business for almost 4 years, and the thumb rule of staying in this business is having a copy of ALL the docs you submitted; even after years. I remember a client asking for all the work done for him in 2 years, and we scraped through all the hard disks, email ids and delivered every single article.

And your argument of a black mark on your account really does not stand ground, as in no way are losing money or reputation, while the buyer is losing some. I'd be more worried about a shitlist on BHW than a failed dispute due to a technical flaw; as this can be seen by prospective buyers, while the latter cannot.

Delayed deliveries are one thing, but this is a case of poor customer support as I see it; might not get you banned, but as Oldsalt said, anyone would think twice before he transacts with you.

May I ask a few question?

First Why is it so hard for u to resend the articles that u already have written to ur cilent?
You dont have a copy I guess

Second When u upload the articles thru e mail it must be a zip or rar and dont tell me you upload it one by one
What happen to the rar? did u delete it?

Most of the writer I deal with keep a copy for a long period of time
 
You don't ask to be contacted, you state your case here or you do the contacting.

by-the-by: A rar file will almost always retain the names of the files contained within, even if the archive is severely damaged, the index of the archive is stored in the first few bits. If you received an archive with nothing in it, the file was empty. If it does have something in it, and you can successfully extract it without error, it's undamaged.

So, did the rar file contain files? If so, were you able to extract them without errors?
 
See this is why I didn't want to shitlist the guy I would hate the thought of ruining his business that he feeds his family with but he has left me no choice really and I hope everyone can see that!!

I'm no rat, snitch, grass or an uncle Tom but u left me no choice I can't recover the money via PayPal!! This was my last resort!!
 
It did contain files and few folders with in!! It was not empty and it was not corrupt it was just the wrong file I presume!!

I'm pretty sure that he knew with the amount of time elapsed that I wouldn't check it right away and sent me the wrong file!!
 
I'm not sure who will win this dispute, but I do know that will never use TensureFP service.

Killakem didn't do anything that could possibly make you mad. This is how clients behave - they pay and they expect to be treated like the queen of England. On the contrary, among the two: client and service provider, being professional is required only from the latest.

I have dealt with the killakem and he is good guy and he is used pay advance. And i can show you the proof of payments if mods wants. I can show the paypal screenshots. I am working with him from past 7 months. And we are working smoothly.
I have read the thread and i am also confused what is going on. Now decision is in mods hands.

It just dawned on me. Your right BleemZ if it was corrupt it would still list the articles I just wouldn't be able to extract. This guy has just sent me the wrong file which he renamed to "Articles-2.zip" I smell a RAT!!

Sorry guys but I see this from a totally different perspective. I see mistakes on both parties and a knee-jerk reaction of the OP soured the transaction. When I open a PP dispute or file a CC chargeback I certainly wouldn't expect any consideration from the other party after I've tarnished his reputation with PP or the CC Merchant. Those disputes whether won or loss do stay on your record and computers suspend accounts based on your dispute ratio. Saying a PP dispute doesn't cause a problem is silly.

Here is what I read and how I comprehend this transaction:

i sent him the payment to cover my next order. This was on the 16/02/2012. I did not send him the keyword until the 20/02/2012

So you waited 4 days to send him the keywords indicating -no rush to me and most service providers.

He delivered 5 of the articles a week later on the 27/02/2012

You took 4 days to deliver keywords and he took 6-7 days to deliver 5 articles. Was there talk of a delivery time when you placed the order or delivered the keywords? Was a date set? Seems there were assumptions made with lack of a details in this transaction.

on the 10/03/2012 nearly one month after sending payment he delivered the second part

You gave him the keywords on 02/20/2012. There were 29 days in February. So 9 days in Feb and 10 days in March is 19 days. That gives you the benefit of the doubt about time zones. Could actually be 17 days if delivered during non-working (awake) hours. Exaggerating a bit about waiting a "nearly a month" isn't being truthful. Just over a couple weeks and not 3 weeks isn't a month of delay. When you made the payment is irrelevant. You didn't provide the details for the worker to do the work until the 20th.

So on 13/04/2012 I had one of my VA's start uploading all the articles we had for that site and he came back saying part 2 from Chad was a rar file with no articles inside

I'm not sure what email client you use but all mine show the attachment size right on the email. Easy to see a 0KB attachment. I didn't even know you could create blank rar files. My program says nothing to archive. Regardless, to say you received a 0KB attachment, saved it and forwarded it a month later is very difficult for me to believe.

I contacted him the same day and received no response. So I tried to open a paypal dispute to get his attention

So you emailed him on 04/13/2012 about a file you received on 03/10/2012 and you waited less than a day for a response before opening a PayPal dispute? You think that's good business? You opened the dispute although you admitted you received and confirmed part of the order on 02/27/2012? You were trying to rip him off for at least 5 articles the way I see it and you gave him an unreasonable time to respond to your complaint. There lies the knee-jerk reaction on your part and the end of the transaction.

PayPal must of opened it or it wouldn't have been closed because of the 45 days limitation. Regardless you had a snowball's chance in hell of winning a PP dispute even if you were under the 45 days. PP disputes rarely work with intangibles. You severed this transaction when you filed the dispute in bad faith. You didn't allow the provider enough time to respond and you already received part of the order without complaint. The provider cut and pasted the dispute status from his PayPal account which shows you surely did open the dispute and PayPal closed it. He is correct as this will always be a record on this account.

I believe the provider should have kept your work for a longer period of time to cover his ass but he wasn't under any obligation to do this. After 30 days since delivery and not hearing from a client I would also assume no news is good news. I'm sure the animosity arose when you didn't allow time for a response to the problem and filed your dispute which may have caused problems with his PayPal account for a short time. Doing a dispute for 15 articles when 5 were fine isn't fair to the provider. You tried to fuk him so why would he be considerate now to you? Just saying...

I say this isn't a valid shitlist thread. I think the OP is as much to blame for the problem as the provider. He didn't review the deliverables in a timely manner, didn't allow sufficient response time before filing a PP dispute for the full amount even though 1/3 of the order he received over a month earlier.

What happened with PP is not something bhw can do anything about. I understand it's an issue, but nonetheless, we can't force anyone to do something outside the forum. So enough about the PP thing.

I don't see how this is going to be resolved here. I'm sure you both got plenty of logs/emails, but I don't see how bhw can work out a solution for you.

OP and Service, what do you want us to do?

I don't feel like I need to justify my actions to you but I will anyway.

Firstly I didn't say it was empty I said it never contained articles as you can see above.

Also I at no point said hundreds of articles would be awarded to the individual hence why I would not take the bulk order price and paid the single article price. I made no mention to him that this project would be for hundreds of articles i was just trying to give a view of the volume that im working with.

In total who would see this and presume they was getting a project for hundreds of articles. This is irrelevant anyway like someone said earlier. You only enter into an agreement once funds have changed hands.

Hi chris, I am really sorry but I am still swamped. The articles will be delayed by another day. To make it up to you, I will do the next batch of 15 at half price if you want.
