Forced to remove an item from Eb@y

I had an item listed and was making about $25 per sale. I was selling an average of 12-16 of these a day for the last two weeks. This item, in addition to the other related products, have made this venture a very successful one.

I was just notified by Eb@y that they removed one of my listings because of it possibly being counterfeit. I refunded over 40 people last night and had to give back about 1k. I don't sell knock-offs. These are all 100% legit. But the company that makes the product, doesn't want it to be sold on Eb@y. So now, I am making an e-commerce site with the same products along with the product(s) banned by Eb@y.

My question is, will using Payp@l as my payment option on my new site screw me too because they are owned by Eb@y? Can this company make a claim to P@ypal and claim that these sales are unauthorized in the same manner and force Payp@l to close my account?

These products are legit and are being resold after I purchase them from an authorized buyer.

What are my options to sell these online? How can I get around this? These products sell themselves, especially during the holiday season.

usually paypal does`t have any issues on other sites besides ebay. they are pretty fucked up on ebay but work on other sites
 
No, although I was suggest moving to a merchant account. PayPal isn't likely to analyze and compare eBay actions to what you are selling through your own website.

Just curious, do you have any competitors for this item? You may have had your selling of this item limited due to competition making false claims that your item is counterfeit, and if it really is not, then I would be more than happy to help you.
 
You could use google check out if you are concerned about p@ypal screwing you. I use them for the higher ticket Items I sell.
 
Normally your accounts will be affected if they are linked together.

If they aren't linked chances are the only account that gets limited is the one you used for the transaction. Depending on what you are selling.

eGay and Aypal seem to not know what the others are doing unless the accounts are linked or you are using the same ip.

Chances are there is someone selling the same item and not getting many sales. So they are pissed off and making false reports to try to get you banned or you to stop selling the item.

If eGay limits you, but Aypal didn't, just create a new account. Chances are they didn't limit you yet just to see what you do. Sooner or later they are going to limit the account.

But if you just have a new Aypal account setup on your own site, you can sell the products with no problem. As long as your customers don't report you.

If the company proves they are the makers of the item, and they can show that the items sold were not meant for resale, you may have problems.

But usually the only way Aypal gives you trouble when selling on your own website is if a customer files a claim.

That was what I was going to say...very true.
 
What you have realize is even if your products are real and you are buying them from a legit source. A legit source will not sell to you if you are not authorized by the company to resell the items (IE storefront) Unless its a liquidator you are buying from. It's one thing to resell a new or used pair of jeans you bought but to sell it in qty thats another thing. Unless all the items are used. If you are selling 300 + items a month of the same product you would need to be an authorized dealer from the company that manufactures the item itself. What I mean if you are selling Lacoste shirts you have to have a store and a line of credit to buy from them. Second if your source is selling in qty he would have to be a distributor for the company and these people do not sell to anyone w/o a storefront and a line of credit from the company. Lets say you are selling Black Lacoste shirts there is no Lacoste dealer that will just sell you black Lacoste shirts you have to carry the whole line. So if you are not a reseller it makes that real product counterfeit because you not not have the right to sell the product that is why ebay shut you down. Paypal will not shut you down if you sell from a website. What can happen is if the company of the product finds your website they will shut you down sue the heck out of you because you do not have reseller rights. If you still want to sell on ebay do not have any pictures showing the item in the gallery. Have like 3 pics and your main pic could be a smiley face but the other two pics are of your item so when people look down the auction listing they only see the smiley face and not a pic of the item itself until they click on your auction link. Good luck with this. I almost lost everything thinking I was buying from a legit source.

It turns out that my items were removed because my photos of these items were stock photos. The company claimed that because the photos were stock and not real photos that I took, that these products have the possibility of being counterfeit. When you list an item with eb@y or am@zon, you can put in the upc or sku # and the info pops right up. It's there to help you sell! Then two weeks later after selling like crazy, they tell me that this is what I am not supposed to do?!?!? Figures that one owns the other, they both think alike. ***Can anybody recommend another checkout vehicle to help me process my payments? Is there anything as easy as Payp@l? What about G00gle?

Unfortunately, you have to give them the information that they want. Or, you might tell them you are going to take a legal alternative as they are forcing you to disclose sensitive business data. This could only (maybe) lead to them allowing you to withdraw your funds, but I doubt they would take the lift off of your account because of that. If you have some money trapped in there, maybe you should actually go to a lower for a hundred (or a couple hundred) bucks and get something written out, fax it to them.

At least this way you'll get your money back, PayPal is operating illegally anyway, I highly doubt they want to get any legal action taken against them.

But to unlock it, and for further use, you might need to unfortunately co-operate with their illegal activities and tell them your source, and cost.

Furthermore, if you don't have a PayPal account, you have unfortunately lost a large customer base on eBay as most people pay with PayPal because they 'think' it is safer (which, for the buyer it is, but anyway) and you'll likely suffer from large loss of sales by not offering PayPal.
 
Yes, I was thinking of that. It's gets funnier though. I was just in my email and received another email from PP. I was just approved for the PP masterC@rd. According to the email, this allows me to instantly access my funds wherever the MC logo is displayed. And the Pp dividend just hit my account as well. These people are nuts.
 
From you requesting the PP master card, that is what probably triggered them limiting your account as the same exact thing happened to me.
 
Yeah, maybe. Who knows? I applied for the debit card just so I could withdraw the money quicker and pay back my dropshipper. Now I can't do squat until I show them the invoices and prove that these products are legit which will also free up the 8k I have with them. It got me thinking...If I were working at a department store, would I ask to see the invoices that say, Macy's, has on file to show me that the products in the store that I am selling are legitimate? No way. It's not until complaints are filed for the claim otherwise that Macy's is selling knock-offs until something is done. How the hell can they do this and get away with it? I have provided over 200 tracking id's and 200 positive (practically gleaming) feedbacks from 200 more than satisfied customers. I don't get it. And now the tally has surpassed 3k that this has cost me because I can't sell a damn thing.
 
No, nothing digital. Actual physical tangible products.
 
if you have a big amount of $$$$ blocked in your PP account and you want to recover them, just send them a false invoice (there are tons of templates here and there) and it will be ok, PP wont look too closely at it and you will surely be able to recover your money
 
I've had bad luck with paypal/ebay over the past year or two, enough so that it's pushing me more towards Amazon and Craigslist.
