Debt Collector will Not Stop Calling Me / Can I Blackhat Them?

if in the u.s. send a registered mail w/return receipt cease and desist - beware the repercussions which will accelerate the collection process however.
 
I had this same problem with Wells Fargo. They kept calling and asking for someone I've never heard of.

This went on for weeks and they would not stop.

I finally got an attorney who got me a settlement of $1,500.
 
Tell the guy on the phone to hold on because you were cooking or something like that and just put your phone on hold. I did this once and the guy hung up after 30 mins! :eek: They never called back tho :)
 
Well looks like you might be due some cash:)

What you need to do is document everything calls, number, times, etc.
Screen shot the number on your caller id or your cell what ever they call.

If they call your cell phone and its not a business line they are violating FCRA.

When they call your home line depending what they say or do they violate FDCPA.

If it were me I would record the calls and try to get them to violate on the phone.

Because the debt is not yours and you are not the person you should send them a letter CMRRR "certified mail return receipt requested " demanding they stop calling.

If you nail them with any FDCPA violations it is 1000.00 per violation but to get that multiple times you have to sue separately on each violation.

Usually when you have them on violations and you send them an ITS letter "intention to sue" they cough up the cash. It is cheaper for them to pay you before you sue as if you get a lawyer they are also liable for lawyer fees as well.

If you plan this out right you could get some cash.
 
If you get a live person (ask them for their name) and tell them you are recording the call and you are sending it to the AG by name (Fl and Ga).

If it is a recording and it offers a response, do the same.

I may have run into a problem, I call the FCC and they asked if this was a company phone? I said yes, they then said I am not the owner of the phone so I can't file any actions .vs the Debt Collector.

Is this a real loop hole for these A-Holes?
Bullshit, the fact that you are not the owner of the phone makes it even worse.

They are not harassing a phone they are harassing you, owner of the phone or not. In fact you can ask for a cease and desist of all phone activity and then all they can do is either contact you through mail or take you to court. Since you don't own the debt they will lose.

As was mentioned send them a letter, certified return receipt, asking them to validate the debt and that the letter serves as a cease and desist against phone contact. If they continue after the date they get the letter and you can prove that (via return receipt) they can face a lawsuit by you.

In fact there is a blurry line, once you send the request to validate they should also remove any marks on your credit report until the debt is indeed validate. Why? It is implied that the mere existence of their mark on your credit report is an attempt to collect a debt. The validation letter forces debt collectors to cease all collection efforts until the debt is validated.

Sadly none of this applies to the original creditor, unless something has changed over the last 10 years.

What that means is if you owe me $5000 I can call you and I dont have to comply with your validation letter, however if I outsource my debt collection then the company handling the debt collection does indeed have to comply with the FDCPA.

Easy dude....first ask the person that calls u for the full contact details. Including email address, landline and mobile phone number.... register his email address on as many fcked up spammy lists u can find..from sex toy websites to gay dating websites .. then create a few craigslist and gumtree ads... using his phone numbers.. say that he a straight dude wanting to experience his first male on male action...stick his phone numbers in the add....keep sending as much adult/porn shit to his email as possible.. BUT now for the cherry on top!!.. Using his name and surname, company address... phone a few escort agencies/strippers.. ask them to send over their fattest uglies skankies chic over to his work address...tell them to go to reception and ask for him by name....THEN phone a few car dealerships in his area... like 5 of them.. tell them all that u want to test drive one of their cars.. say that ur car was recently totaled in a car accident so if they don't mind bringing the car to ur place of work so u can test drive... tell all 5 of them to come to reception and ask for him by name...but send them all their at same time!.. so u tell them to bring the car over at like 11am... :)
 
Cellular phones may soon no longer be off limits for fed collectors. The Obama administration's deficit reduction program, if approved, will allow collectors to call cell phones of borrowers with delinquent federally-backed loans. These debts contain government student loans, most home loans and back taxes. Currently, debt collectors are only allowed to call home phones.

A workaround is to wean yourself off of cell phones or voip phones in your own name. This is easier to do with true prepaid phone systems like Virgin Mobile. Use pseudonym names or business name in setting up accounts where possible. Some use a relative with a different last name. Make life difficult for collectors.
