Debt Collector will Not Stop Calling Me / Can I Blackhat Them?

About a month ago I start getting calls from a Debt Collector. I told them I was not the guy they were looking for and that was that. They started call again and I asked to speak to the owner of the company. I got a gatekeeper who was very nice, took me number and said the calls would stop.

But they did not, I talk to them two more times and guess what?

They keep calling.

Now if I had a debt with them I would have to deal with them. But I don't and they are looking for another guy and will not stop calling. He name is not even close to mine.

My head office share the same area code as them, so every time they call I stop what I doing to hear their recorded message. It gotten F-ing old!

What can I do to them (Black Hat) to piss them off?

Not sure where you are from, but...

1.) Google the debt harassment law for your state. Usually there is a clause in there that says if they keep knowingly bugging you you can sue them in small claims court for a fixed amount - often in the low thousands (doing this by memory, so I may be wrong).

2.) Document how many times they call. Tell them you don't want them to call, but be a total wuss about it, making sure they call back.

3.) File multiple small claims lawsuits.

4.) Profit!

Im thinking something along the lines of signing their number up with other telemarketers. If its an 0845 number (I don't know what the Yankee equivalent is) scour the web for the normal equivalent via sites like saynoto0870. You at least have a chance of clogging up their lines. All debt collectors are scum so I wouldn't really call it blackhat. I'll coin it karma hat

1. You find out who they are, all of their contact info, and their website, and email. Next time they call tell them you will try to get the person they want and that you need to know how to contact them. Get as much as you can especially name so you can try to look on line.

2. If you know SEO it would be very easy to trash someones reputation or something like that .of course your negative attention will help them with the serps.

3. Post there information on this board and everywhere that you know blackhatters hang out. Tell them that this person has been harrassing you and for someone to please help. I think you will find someone to help you. Peace.

Use the web to locate the street address of the collection company (not the box address), or get the info from the supervisor if they phone again.

Write a validation demand letter to them, informing them you will only be discussing the issue with them in writing, that you consider the calls at home or work to be harassment. State you will accept the claimed debt only if they submit validation info to you confirming the debt is legitimate, and that they are the legitimate owners or collectors. Stress you are demanding THEY validate the alleged debt, not for you to 'verify' your information.

Add many requirements (all original documents, et al) they must submit to validate, and put a 15 day deadline on your demand. And add a statement that you will offer to receive phone calls from them only IF they agree to pay you $1500 per call, and that their receipt of the letter constitutes acceptance of your offer. Send the letter to them by certified mail, with return receipt.

This approach is known to stop collectors cold, because they won't comply with your conditional acceptance of the debt, because these guys never validate it. If they don't comply in 15 days, they have 'dishonored' your acceptance and have no legal basis to continue to pursue collection. And they can't call you, for the same reason, and because it's going to cost them $1500 a pop, which you can collect in small claims court if you want to press it that far.

I may have run into a problem, I call the FCC and they asked if this was a company phone? I said yes, they then said I am not the owner of the phone so I can't file any actions .vs the Debt Collector.

Is this a real loop hole for these A-Holes?

What ZebraHat is describing is the Fair Debt Collection Practices Act ("FDCPA"). Those magic words will get the collector's attention.

In short, write down as much info as you can about each call the collector has made (date, time of call, name of person/company, what was discussed, etc.) and hire a Florida (not GA) lawyer to sue. Under the FDCPA, your lawyer will get paid from the collector who is violating the law, not you (the FDCPA provides for your lawyer to collect statutory attorneys fees of somewhere between $1000-$1500 - I can't remember the exact amount - for EACH FDCPA violation).

You want to sue the collector in FL because it will amount to more cost and headache for them.

Here's what I do for a good laugh:
Tell them that to call you back tomorrow, that you don't have your accounting in front of you. Then ask them what time it is in their time zone. They will always ask what time zone are you in. You tell them you are in China. They always act surprised, at that point they will say, China? You say well by the time you call me back tomorrow I will be!!! Have some fun with it, life is short
