Copyright Strike ! Please help !

Hey Guys .. i hope you all are doing good ... to go directly into the topic .. today i received a copyright strike on my 3-minute video for using about a 30-second clip from another channel but i was doing a text commentary under it explaining something ...
Isn’t this considered under fair use so i can fill a counter notification ?
please suggest me what to do ?

you can get in touch with the person who claimed your video and ask him to retract his claim of copyright. (ask him gently, tell him you was just explaing...).

- fair use cases are decided by the court of law not Youtube, but you can submit a counter notification and try your luck.
 
there is an option to remove that part m revove it and you are good to go
 
Every case is different.But the law is clear and I think we all had some similar issues-just try to get in touch very carefully-according to guy's content. You have to be very polite and shy-looking guy :). Try to explain him/her on your best way(even state that you are absolutely newbie). Good luck:)

contect with the person who claim on your video.
 
Content ripped from 'creative common' can only be reused
 
Well if it's only say 30 seconds then to me fair use applies to it you should reply back polite asking them to remove it if not you have two options just delete the video or have to submit I think it's called counter Copyright where you have to submit your name and details to Youtube to get it sorted out in theory
 
Was it a reaction type of video, or did you just take someone elses content?

If you took it, just delete the video, it's not worth the faff
 
i will try to solve it friendly ( if this failed the other option is a counter notification ) however he used a threatening language yesterday & i told him that i am under fair use then he said ok i thought you copied my video
After this like 5 hours ago i was surprised that he filled a copyright take down.
The point that i want to understand is using a part of his video in mine to illustrate something is considered as copyright infringement or fair use ?
i see a lot of big you-tubers using other videos with commentary without problems $

Deleting it would not solve anything it is already taken down
 
Thats not an issue. go and do the work. the exact same happened to super affiliate masters. focus on work and deliver value. don't care about what people say, care about your business and help those who need help. the more people you serve, the more money you can earn.

So what about all those reaction channels & the clips that big Youtubers use in their videos i think not all of them are under the creative common section

not reaction or not copying his video ... i took a part to explain something then the rest are my own clips

Gaming he was doing a trick so i showed the steps he mentioned then applied it on my own account of this game ( showing both parts his then putting my own clips )
+ i didn't just put his clip raw there was a text commentary from me

The best answer is to contact that person.

It is but the guy who striked probably doesnt care. You can try to appeal it but the appeal goes to the guy and not youtube so he will propably reject it unless its an automatic claim which a network did it for him.

I think text commentary is not enough. It should be voice commentary. You should talk over his video and maybe break the video to 2 or 3 parts ie not just straight 30Sec

lol dont be afraid.
when you get strike for such cases from individuals instead of companies or record labels, and since you already added some commentary, just dispute it on fair use grounds, its easier for yt to approve your dispute, in cases of individuals.

if they approve your dispute, then the rights holder will have some days to take you to court.
99% of people wont do that and its too expensive.
he wont do that, and the strike will get auto retracted if he does not.

just dispute him and done
