Hi, I was wondering if anyone had ever dealt with a trademark dispute over the name of their blog? To cut a long story short, I've had a site up since 2012 and have recently applied for a UK trademark. I received an email from a company based in another EU country that they are planning to launch a product with the same name in Europe. Their trademark was granted in their home country in 2014. They have not applied for an EU-wide trademark as of yet.

In terms of what I produce and the product they are planning to launch, there is no overlap, but obviously having a potentially popular product launch with the same brand name is less than ideal. Any ideas on how to proceed until my UK application is approved?

I don't know much about EU law, but if you've been using the trademark for 3 years now and you've already submitted an application for the trademark, shouldn't your application have precedence over their application?

was the other company active before your blog?

My advice: talk to a lawyer who is specialized in this field. This is way too complicated for an Internet forum.

Some lawyers do free 30 minutes consultations, find a couple of them...
