Are Press Releases Duplicate Content?

Ok there is a site in my niche that has about 80% of their content come straight from press releases.

They get press release feeds, publish them word for word on their site, and somehow those re-published press releases show up in Google news alerts and in organic searches, often as the top result for that keyword.

Apparently, they are not getting penalized for duplicate content. So, can I post press releases without fear of being hit for duplicate content? How is re-publishing a press relase NOT scraping content?
 
From what I believe, since the press releases are sent out to so many outlets, including websites and news sites in a way that they do not provide the entire release/content.

Which is how your not hit with dup-content.. Like from what I've seen, other sites hosting the press release will only show a snipit and not the whole thing. But defiantly make sure your press release contains original content tho.
 
Well this particular competitor posts the whole press release, word for word, not just a snippet. And for this keyword/niche, they are an authority site. But the more I look at their site, the more I realize it's mostly press releses, with some unique articles thrown in.
 
It still has some weight on it if you're the first one who posted.

Are you sure press releases that are dup content are the only ones posted in their site?

It might be possible that because of this, in a few weeks, their ranking will slowly go down.
 
If you pay for a professional PR from somewhere like PRWEB.com then you're in the clear. I've seen great SERP increases from using professional PRs.
