2nd Copyright Strike from same Guy ! HELP !!

Hello Guys !
So again the same guys gave me another copyright strike on a video for using his thumbnail like 5 seconds ( good job YouTube )
The third strike & i am going to lose my channel Here is a link of a video similar to the one who was taken down
( his thumbnail appeared at 00:25 to 00:28 & 1:58 to 2:00 ) nearly 5 seconds
Please check it & tell me if this is considered as a copyright infringement or it is under fair use I was planing to take the channel to the next level by adding a FACECAM & upgrade my content But when that guy sent a copyright strike you can check details in this previous thread last week :

He started to abuse & threaten me on Instagram so i decided to fight him under fair use( big lol ) - Never trust YouTube ( any kid can give you a copyright strike ) Now please guys what do you suggest .... I can make a Jr VIP or any Trusted member here on BHW a manager on the channel to help me solve this issue if any has experience in this topic Please if you have anything to offer.
Now i want to quit YouTube than any time before :(

Note : my previous counter notification got rejected but maybe i did not write it perfectly.

Wow, just dont use other peoples shit and you wont be copywrite striked why still use them when you know he is watching for something to strike you

5 seconds is considered as other people shit .. then all reaction channels + PewDiePie should be terminated.
 
Unless you can provide proof you own the photo or images or content you uploaded or got permission from the owner then the other person will win and if you keep doing this to the other person or someone else then your channel will probably get shutdown .
 
Google isn't an arbitrator, they are just enforcers. Even if his claim isn't valid and falls under fair use, Google is most likely to hand out a claim until proven otherwise. The moral of the story is to ask permission before you use other people's stuff, or don't use it at all.

dispute him on fair use grounds and just wait.
if he does not take you to court, the strike will get auto retracted.

most likely they will approve your fair use dispute unless the guy who is striking is pretending to be a company. in in this case sometimes your dispute will be rejected .

make sure to dispute all his strikes

He controls if the content is taken down, Yt gives him a message when anyone uses any or a small part of the content he uploaded. It's not automated, only big productions are.


Here a shot from my removal requests, I'm also a guy that doesn't tolerate theft. The ones with the dashes lost their channel.

Me too i have access to this & some people copy my content but i never hurt anyone at least i will contact them friendly first.
+ for my case it is not a theft check the sample video i provided.

After ten years of stolen content, content that's mine, I'm done with it, no pardons anymore.. They have to ask me at first, not after.
 
you should state your channel instead of providing a video that has a similar content to yours.
 
If you haven't resolved the issue, you can always contact YouTube support through their Twitter account.
