You are jumping to way to many conclusion. When the program tries to connect to the FTP server, it is rejected. Why would you automatically assume the trojan author also owns the server? Sounds like the server might have been compromised by whoever is responsible for the trojan, and the server...

You posted publicaly that you registered it based on it's similarity to clickbank, and by simply redirecting traffic to a clickbank affiliate URL you are displaying intent to profit with bad faith. Clickbank would have a very strong case.
