I've never had this problem before. If you don't think about the way you promote your link, you're bound to get banned quickly. Be smart about the way you put in your links to advertise it, and you'll have no problem.

Cloaking your links based on your site's URL is a good idea for any links really. It's a good way to track each links yourself as you control them through your site through cloaking.
Of course in the long run it's better to build your own site so you have more control later on. For the short-term, you could experiment with big authority sites to see if you get any good results.
#1 It's a niche with a lot of traffic, so you shouldn't be worried if it's good enough. The only way to know if it works for you is to try it.

It depends how you use it I guess. If you use it as your brand identity then it could be copyright. If you use it in your content and rank because of it, I don't think it'd be against copyright then because you're just using it naturally.
