Catfishing: will there be legal issues?

Lets say I would start and build a girls instagram. And use a unknow girls her pictures on that instagram, are there any legal issues and can my account be banned?

-its illegal
-your account can be banned if discovered (all it takes is one report of identity theft)
-you could be sued but it's very unlikely

A girl I know had her photos taken for exactly this, she knew about it very quickly and got the account taken down in a day or so.
