Its not a scam if you read the TOS, so trend lightly before you call me a scammer. I have over 100 active clients. But regardless, I have changed up the term unlimited. SO, your saying your cellphone company is a scammer if they offer unlimited data, so you are also saying your internet provider is a scammer if they offer unlimited data? Get off your high horse.

Yes we have DMCA ignored hosting, but we offer a LIMITED set defined amount of disk space now :)

I'm not sure if it fits into the category of scam, but it's definitely misrepresentation. The fact phone / internet / hosting providers get away with it legally for some reason, doesn't mean it's right to claim something is unlimited when it clearly isn't. If it's fair-use, then "UP TO X GB per day / month" would be more appropriate.

I totally agree but I dont believe I fit into this, because I didnt fraud anyone, but I could understand a dishonest scheme. Like I said, it wouldnt be dishonest if people read the TOS. But, since this, I have revamped to another method of just limited space. So, again this was to make users aware of unlimited schemes.

I know, i'm not having a go at you personally. I'm surprised internet / phone companies get away with the same tricks TBH. Many other industries get slammed for false advertising. I don't see how it's any different advertising "unlimited" refills in a restaurant, then after the 2nd cup saying - sod off you've already had 2. Then using the argument it's fair use refills since it has to go around everybody, without making that clear before people hand over money. Tucking caveats away in disclaimers shouldn't excuse front-end misrepresentation. Again, not directing this at you - just in general.
 
Interesting discussion, in our country a local Telecom company started shutting down broadband services as they were selling Unlimited Broadband and for some strange reason were surprised that people were using more than the 275MB they thought was fair use for a family of four. I know for a fact that I use at a minimum 2gigs per day.
Good thing that I did not signup for their unlimited offer, but stayed with my current provider who seem to have a more reasonable definition of unlimited.

There's so many things wrong with this statement, especially telling another member to get off their high horse.

1. Your TOS doesn't even apply in this case because you don't have WHMCS setup correctly and customers aren't required to agree to your TOS before placing an order. Since your apparently based in Texas and don't have an attorney, I would suggest hiring one to explain to you why this is important. Otherwise, you'll get a Texan that sues the shit out of you and your little TOS won't even be able to be submitted as evidence.

2. Why can't he call you a scammer? You literally said "I agree that unlimited is shady practice" in a post above.

3. Cell phone companies actually have attorneys that review their TOS. They aren't copied from other companies, in other states, with different laws.

4. You shouldn't use having 100 active customers as an excuse for anything. In the web hosting industry, 100 customers is nothing.

5. If you think 65 GB is an issue, you should never even mention the word "unlimited". I've had a little over 800 GB sitting on a shared server at HostGator for more than 4 years and they've never had a problem with it. So if you're going to claim unlimited, learn how to do it right.

I'm not saying this to make you feel bad and I'm not even against unlimited hosting, most hosts I use offer it. But you can't start a discussion that's based around the industry you're involved in and advertise here and not expect people to give their opinion of it - and when they do, you can't make them out to be the bad guy and tell them to get off their high horse.

As soon as they click on that package then yes they are agreeing to the TOS, I have provided. I have had 3 different attorneys check my TOS, and separably agreed there was nothing wrong with it. I have since amended this unlimited policy and moved to a defined amount.

2) Because I am not a scammer, if my intent was to scam people would I honestly be in business still after a year?

3) Well, I can agree to this, but I guess the countless other webhosting companies, not to mention the ISPs that have been subject to FDC regulation are still considered scammers? ATT is a perfect example of this

4) No your right 100 customers is nothing, but when I take pride and joy in every single customer and helping them. In that, its a very big accomplishment

I claimed unlimited just the same as every other unlimited webhost provider. But, again, I have completely changed the way we do that business, so I dont feel like this needs to be a continued topic of discussion. Thanks for your opinion.

Oh and they do, but I dont think its fair to call me a scammer when my intent wasnt to scam anyone. Thats why I felt like it was taken personally, because I strive to help every single one of my customers suceed in what they are intending to do. Unlimited Usage is a marketing scheme and I made an honest mistake. But ALOT of hosting companies, cell phone companies, and ISP's get away with it.

for affiliates.

is to change that Hudson and put up what peoples real limits are. Many people will see that as a good thing, except for
pain in the ass customers. :)

Haha I completely agree with you. I have changed it since the day that happened. I made a mistake and I learned a lesson from it.

Even if companies didn't actively limit services on arbitrary levels of usage, by definition, all services fall short of unlimited. Don't understand why more companies aren't sued to sh*t or get away with using it full-stop.

By default, WHMCS should have the option to agree to your TOS during the ordering process. If you go through your order form to the last page where customers enter their information (name, email, address, etc), you'll see that there's no option to agree to your TOS. This shouldn't have anything to do with the WordPress integration though.

Because if you sue individually for false advertising, you can normally just collect for monetary damages. A lot of the times those damages are limited to the total amount you've paid. So, it's generally easier for most people to just file a chargeback instead of a lawsuit. Those types of lawsuits can get quite expensive.

I would just change the plans and not have unlimited drive space or ram or bandwidth listed anywhere. I would rather loose a sell for not having the working unlimited on my site than to have to suspend someone for doing something wrong and then they go and bad mouth you.

If they only want to host with you for unlimited resources really those are not the customers you would want anyways as those tend to bring more issues.

65gb onto shared hosting just takes the piss a bit.

Saying that I had a friend a few years back who in the UK had telephone landline calls as part of a package.
What he hadn't noticed was these were for 60 minutes then you had to hang up to redial, but he forgot tht bit.

He then used to man-whore about online, meet women in chatrooms and then ring them for hours on end, 7 days a week.
Only when he got a bank statement and found it was £130 light did he discover why.

Unlimited can't mean unlimited and fair usage is the only way to go.
