Video embedding illegal or legal?

Basically I was discussing this with my buddy today on Skype. Embedding videos on your website that you don't own and make money off them, is it illegal or not? I've heard a lot of different opinions on this and would like to hear yours.

As far as I know it's all good as long as the embed link is public and you don't claim it to be your own.

Edit: And to be safe I wouldn't have that as the sole material of the page, but as supporting material.

Nothing wrong with embedding YouTube videos, for example.

I have many sites with embedded YouTube videos that aren't mine that I am using to help make a sale.

It depends on what you mean. If you're ripping the videos, then uploading them under your own account, and embedding, yeah, it is copyright infringement.

However, if you're just using the embed code that YouTube and nearly every other video platform offers, then no. You can still monetize the site, just not the video itself.

Here's a scenario. Let's say I have a site that teaches people the basics of wordpress, but during one of my articles, I don't feel like making a long video that demonstrates how to make a sticky menu in Genesis. So I'll just find someone else who has already done it, and embed their video in the article. I still have affiliate links for themes, hosting, etc in the article, but just not the video. This is 100% legal.

Now, if I find that same video, rip it, blur the watermark, upload it to my server or YT channel, and then embed it, it is going to get a DMCA letter. Just make your own stuff OP, if you're thinking about going that direction...then you can sleep at night, plus you are building a channel.

Hi, thanks for all the posts so far, I forgot to mention that this conversation that I had wasn't about Youtube, we were discussing these websites that embed tv shows/movies like "thewatchseries". They don't upload the content they just embed it and I watched a few shows on there and that's where the conversation started whether or not it is illegal to embed videos like they do.

The Court of Justice of the European Union handed down a landmark verdict this week. The Court ruled that embedding copyrighted videos is not copyright infringement, even if the source video was uploaded without permission.

That was posted 25th october, 2014, I'd like to find some up to date information on this.

Dude you are overthinking it. According to you, half the internet would be illegal. Just embed the video and move on, I promise you that no feds will come at your door no matter where you are. And in the worst case scenario if anything happens, you will only get an C&D email asking you to remove the video.

No country calls that illegal currently so just go with the fact there are no laws against it and even if there were you can use simple loopholes to make it a legal process again.

Don't bother with fear unless you direct upload them to your servers.

Honestly not that big of a deal. I've personally recorded a viral video that I posted, and next thing you know there were a few others that took the video and uploded it on to their channels and sites such as world star hiphop.

It's just the name of the game when it comes to the internet. Don't want people to steal your shit? Don't post it.
Because these people made a few bucks off my video, big deal. I'm not going to chase after them and "sue" them. Not worth my time. Hilarious for people to say that, think about it, am I going to waste my money on booking a flight, a lawyer because they made a few bucks off from a video they stole off me? Nahhh.
