Okay guys I've messaged US Amazon Support and this is reply that I've received. Any thoughts now? Looks like using their images may get you banned/lead to copyright infrigement stuff. What are your thoughts on this?

1. Do you use videos for your promotion?
2. Do you use social networks (fb fanpage) for your site?
 
The Amazon EU Product Advertising API Licence Agreement say:

You will not store or cache Product Advertising Content consisting of an image, but you may store a link to Product Advertising Content consisting of an image for up to 24 hours. You may store other Product Advertising Content that does not consist of images for caching purposes for up to 24 hours, but if you do so you must immediately thereafter refresh and re-display the Product Advertising Content by making a call to the Product Advertising API or retrieving a new Data Feed and refreshing the Product Advertising Content on your application immediately thereafter.

So we cannot store images on our servers but we can only link to an image on Amazon servers (and cache this for only 24 hours, then it must be refreshed).

How else would we get product images? Buy every product just to take a photo? No way man, just use the images on amazon and you will be fine...

So i visited your links from the first post, and a few more posts. I didn't had the time to go through the whole thread yet, but I will. However, I didn't find information so far about the audience.

Are you doing this most on google.it?
Your Keywords phrases are in italian, therefore searched by people from italy?
Do you think this works in english or is too hard / too saturated - so the technique works best for individual countries ?

Some more info from them, now they made it clear that we safely can use only the stuff from asso central :(

I'm sorry you are not allowed to crop any images from our website to use as you like, you may only use images and options we give you in Associate Central.

You'll find our logos and banner ads under the "Banner Links" section of the "Links and Banners" tab. Once there you will see that there are many banners available for Amazon product categories.

The "Homepage Links" category is under "Banner Links by Category" near the center of the page.

I do not know what are the rules for the EU,
for US market you can use the images but you can not use images that users upload.

I want to thank you for including the FAQ section. Not a lot of journey topics do this, and it made my read a lot easier.

I received responses from the team but I wasn't denied to me to use directly their images.
I made 2 specific questions and they answered 2 times without specifying that I can not use pictures of Amazon hosted on my server (they said to use widgets).

Now I'm going to study better their Operative Agreement (in the UE version) and then I will make changes on my websites (if needed).
In that case, I will develop a custom API tool to auto detect images on Amazon (related to my keywords) and insert them in Posts/Pages/Categories + Featured Thumbnails...

I will send more questions to Amazon's support, from what I understand, the operator does not want to answer my question in a clear way (maybe he doesn't know the answer).

They can't answer your question as they don't own the photos they show. They are produced by third parties and amazon has explicit authorization to use them on their site. In other words, they don't have the copyright only usage rights.

And they really don't care if you use the images but the author of images might care (especially if you are monetizing as you are).

(btw I'm also in EU but this is quite a universal way how the copyright works)

FYI, if you are using product advertising api then the licence grants you authorization to use images it gives. I can't link the licence (because I'm a newbie it seems) but google "Amazon.com Product Advertising API License Agreement"

here is relevant quote

Under this License Agreement, we may make available to you proprietary application programming interfaces and other tools (collectively, the "Product Advertising API") that permit you to access and use certain types of data, images, text, and other information and content relating to Products ("Product Advertising Content"), including the following:
  • Data, images, audio, video, logos, user interface designs, and other creative designs; and
  • Textual materials, such as textual Product information.

FYI, using images that users upload might actually be safer than using professional unlicenced images as people who upload these images will probably not sue you for using them.. Amazon just says you can't use them as they don't own copyright..

This is strictly for suing however, I'm not sure what Amazon does if it caughts you stealing their users pictures for affiliate purposes..

Very true, I think Amazon will take action if it is a huge site.

As said before:

- Product images, videos, and reviews written/created by other sources, including professional reviewers, authors, publishers and customers, are copyrighted by others. We display them on our site by permission from the third parties.

For this reason when you're using images you're breaking sellers' copyright, for this reason you aren't breaking any Amazon rule according to my point of view.
However this is not a solution in any case, because you can get get complaints from manufacturers and sellers.

I think Amazon can not ban for this because you aren't breaking any Amazon's copyright law since they have no claim on the images:

- Amazon.com doesn't have the legal right to give you permission to access, use, or display them.



 
I liked your process. I am gonna give it a try, but how do you choose profitable niche or product selection way from amazon that I actually mean?

For example, for a generic site animals.tld
About Cats Page
.. we are talking on this page about different cats [this is a link to Homepage with anchor "cats"] that are nice..

.. we are talking on this page about different dogs [this is a link to Homepage with anchor "dogs"] that are nice..

2. what do you think, G is hiding (make them equal with zero) some long tail searches in Google Keyword Planner? A reason could be that the people to bid more on fewer terms to increase price per click.

You can link homepage with different anchors without porblems. The main reson is to clarify Homepage's topic and to redistribute link juice.
A lot of long tails are searched only 2/3 times a month but if you can get them and use them your contents will be powerful (check webmaster tools to get them).

The European API tos are clear, you cannot transfer on your server a product image, you can only use a link to an image on Amazon server (embedding image on your page, for example) and you can cache this image for only 24 hours, then it must be refreshed. This is not only a copyright question, Amazon want their porduct images always refreshed because they can change images every moment.

So, do u have changed your thme's structure as you can show Amazon products images loading thm from Amazon API on articles, tags, home and category?
