I hired someone on elance to make a website and they arent doing what i want, and they basically done a days work but dragged it right out, and im thinking ive gone with the wrong company, as i havent paid them but i have hired them, can i just abandon it even though they have worked on it, because im not paying for something they messed up/cant do, and they wont fix.
 
i'd say just give them another chance and let them know what you want changed and try to get things sorted out first and see how it goes before dumping/not pay them
 
i have for a whole month.. im sick of waiting now
 
Haven't used Elance in a while but you should be entitled to firing them without payment, if I recall. I think the rules are pretty clear that they have to satisfy the project requirements (you are the arbiter of that) to earn their fee.
 
Fire their ass. Can't believe you waited a whole month... hopefully you learned a lesson here.
 
Month period is a long time to bear crap company.
Point is "Is customer satisfied?" If not they have no right to get paid. It will be your courtesy if you are paying them some percentage out of the agreed amount (as a compensation ~ though it's not compulsory if they have not done even 10% according to your requirements)
 
Didn't know you waited a full month, i wouldn't been that patient... i'd go with another company and of course do not pay.

Well if the website is not what you described and asked for you can open a dispute for it claiming that they are dragging the project for far long then the time expected and not doing as it was agreed upon
 
After a Month you cant Simply tell then you dont liked their work
It depends on terms of agreement if you can withdraw without paying or not
 
I'd at least talk to them and let them know you're considering firing them and see if they up their game
