Guy Taking my Content word for word will I be Penalized?

Generally if ur content was indexed first before his then u should be safe.... u can also send a notification to Google informing them about this...they will sandbox his site....I had a client who had a simular problem and that's what he did..

The case at present is low cost (I've handled it to this point, but we're both assuming google doesn't even show up to the hearing), but there aren't enough complaints in this state to go class action with it.
Google will undoubtedly be paying our attorney fees anyway. The EFTA is an interesting beast, as you cannot "waive" rights under it in contracts. Google is claiming that the "waiver of liablity" in their terms caps our damages. However, so far it appears the court disagrees. One of the rights in the EFTA is to proximate and real liability that any "balance" holding account has if they do not follow it, and these rights cannot be waived. Many companies who hold client balances may be subject to the EFTA and regulation E and not even be acting upon it. Current guidance by the Federal Reserve states that any balance carrying account (gift card, merchant services account, stock account, trading account or otherwise) is regulated by the EFTA and regulation E.
At least in district court it will generate legal precedent for others state wide to go after them if they need to.
The Attorney General's office also received complaints from us and several others, and advised us to seek class action status as well, but it's too drawn out for my tastes to do so.

I believe that's quite right that I know little about Google and certainly a lot less than you, but that system seemed so easy to implement and also, come on... that's simple common sense. But you might be right that it is not.
Most importantly, we should never wait for others to fix our problems, we should take them in our own hands and deal with them properly...

I know this is kind of an old thread, but I'm having the same problem. Some fucker is even outranking me with stolen content completely unrelated to the domain of the website that he didn't even write!
Here's the thing though... He changed a few words here and there to make it look original. A lot of phrases are still the same, and any human being reading them side-by-side will be able to tell that he copied my article. But will a DMCA request be valid if it's not word-for-word? I already put one in, so I guess we'll see how it goes, but has anyone succeeded in getting stolen content removed, even if a few strategic words and phrases were changed to make it look original?

Send this and the guy will remove it. If not then ask his host or the domain registrar. Make sure to get your content off that site.
