Going bankrupt vs trying to pay it back?

Well, for whatever it's worth - I believe you don't have to file bankruptcy if you are not going to pay - just ride the 7 years. Of course you will be blasted with threatening phone calls and letters, but from what I gathered - no bank will take you to court for $35k as they already made their money and they prefer to offer 50% to the collection agency.

I know a fellow here who owes almost $50k to one credit card bank and he owns a house and 2 cars and no sheriff is on his doorstep.

BTW - I'm also in Canada
 
If you have assets that will cover the debt then you will not be able to file bankruptcy. You might get away with a chapter 13. If you call them one at a time, ask them what they would settle for. If it is agreeable then get it in writing before you send them any money. Depending on how long it has been, you may get away with 50% reduction.

you Do get an exemption amount for cash and assets and everything over that is subject to possession by the creditors
 
Well, where I come from, using someone elses money (i.e a bank) to make money is a tried and tested way to success. If your credit score gets fucked, no lender is going to touch you. You won't get a mortgage or if you do you will pay 4% higher than everyone else, you won't get a car loan and you wouldn't be able to start another business if IM goes tits up.

Your credit score is with you forever, IM could be gone in a year with a change or two from google. $35k is like a car payment. dedicate $400/month to it and in 5 years it will be all gone.

5 years is really old debt. It was charged off LONG ago.

The statute of limitations on that debt is 7 years

You can do a series of "debt validation" letters to the credit reporting agencies and probably get all these removed.

Or wait 2 years and they have to remove them anyway.

So after 7 years even if I file no Bankruptcy they will all be removed and my credit will be good?
 
No, your credit won't be good, but they won't be able to chase you for the old debt

You will have to build up your credit.

Well, to simplify it - your credit is already screwed, so either way you will have to rebuild it

2. statue of limitations on the debts - runs from the last payment you made on the accounts

3. at this point they maybe take 25% of the debt to settle - so for $8,000 you maybe able to get out of it right now - if you plead poor/family issues etc


I don't know how much it costs to file bankruptcy - but seems you got some options right now.

I heard that somewhere too that they would settle for 25%. I would pay $8000 for sure no questions asked, but 30000+ is too f'in much!
 
You`re in Canada, you don`t have to pay shit, never did, never will. I personally wouldn`t have paid what you have paid so far.

Stop looking for any expert help on this, all experts will tell you the same shit.....the shit they`ve been taught on how the whole credit system in Canada works....but they don`t know shit, but they`re clueless that they don`t know shit.

Never listen to an expert on this matter, they`re trained to think within the lines.....inside the box.

The Canadain credit system was my main area of revenue for almost 20 years.

As a young man I was taught how to manipulate it by the `true`experts, crooks theyre called by the government, but theyre really shady entrepreneurs, they were great guys, they taught me alot about how life really works as opposed to how it looks like it works. Same with business and the Canadian credit system.

My advice is to default on anything you have left owing, you should have done this from the start, then you would have had money to start another venture and get back on your feet. DO NOT CLAIM BANKRUPCY.....ever in Canada.

Reason being is because even though it`s supposedly off your record after 7 years it really isnt, it`s there for life, they just cant deny you credit based on it ....after 7 years.....but they can still see it....and some bank forms...loan forms....financial forms etc can ask you if you`ve EVER claimed bankrupcy....meaning Ever.....not asking in the last 7 years. There goes the whole 7 year bullshit theory by the experts.

No a bank cannot hold it against you technically, but the loan officer, bank manager....can still see it, it`s a psychological thing, you dont want it there.

You dont have to claim bankrupcy in canada, in the states yeah, its a form of protection, in cananda it doesnt matter, credit agencies have no real power here anyway....in the states yes they do, in canada they dont, all they can do is call and bug you, thats it. so change ur number every 2 months, ive done it.

credit agencies are stand alone agencies in canada, they have no power, even though they still nuerotically believe they do. Anybody working for a credit agency in canada will tell you all about how much power they have, even though theyve never seen it, strange but true, they are so delusional.....they actually believe they have the same power as credit agencies in the states.

Ive been on the phone with many over the years telling me all the horrible things they were gonna do, then me telling them to fuckoff and hanging up and changing my number....again and again....i was such a little bastard in those days.

Anyway, the fact remains, they cant touch you as long as you default, claim bankrupcy and it gives them all kinds of legal loopholes into your life you dont want them having.

You do what you want, but i advise default, it works and theres no mess afterwards and in 6 months to a year they will forget about you and write off your debt, maybe 2 years, depends.

I`ve advised a few people over the years, one guy that owed 4 million, he was a buddy, and he wouldnt be back in business today if he would of listened to the so called experts instead of me.

Also, there is a way you can start a brand new legit credit file, i suggest waiting 6 months after defaulting though. And no its not that dumb business number bullshit they pedal in the states, mines legit, people have paid me for it, ill give it to you free, im not posting it here.

Do not attempt any of the shit in the usa, or try to default against the canadain gov, it cant be done.
 
So basically you've confirmed what I said.

I remember years ago I've had a debt on Canadian Tire card - I wanted to pay it back, but they started piling up interest. I've called the manager and he flatly refused any breaks, so I told him to fo and that I won't pay and I didn't as a principal. 4 collection agencies and 7 years later it was over. I got a credit card within months after that.

I was a good boy later on, but I wouldn't hesitate to do it now as banks are really pissing me off and I see them as the source of most evil on this planet.
 
Here's what I know. I've paid off debt that was charge offs, and I've filed bankruptcy before too...

If you pay for a charge off, you just added more time on the credit report. It still looks like shit, just adds more time on your credit report.

With the bankruptcy, (Chapter 7), I was approved for 3 different credit cards right after. You have better chances to get credit with a bankruptcy than you do with just shitty credit.

I'd either not pay anything at all or I'd file for bankruptcy.

Don't know how it works in Canada but many years ago when I got swindled by my first business partner who left me with all the debt, I was able to go BK without a lawyer. I did find the swindler in another state and got him put in jail and he had to pay me back but that took some time.

I filed the BK paperwork myself and then was scheduled for a hearing and got a case number. Then when a creditor called I gave them the case number and never heard from them again, it was all unsecured credit cards.

I never did go to the hearing, just needed the case # to give to any creditors that contacted me. It still showed on my credit report as a BK but didn't have to pay a lawyer and had no choice but to just pay cash for everything which is always possible if you have no choice :)

I suppose things are different now with the economy but I enrolled in some computer college classes and it was easy to credit cards again and build up credit. Not sure if being in college helped but it was easy to things going again...

If you have a business and business license it seems that you will get credit cards in your business name easily as well. I was getting pre-approved cards sent to my business name with good sized credit limits or would get approved when applied and don't know why.

I think they just automatically approve some apps without checking everything out?
