Valid point. But there should be some strictness also. Like if they do not punish spam, lot os useless sites will appear in search.I haven't experienced it. But they might shadow ban your site. One of my sites reached zero impressions and traffic, and then returned to previous positions after 2-3 weeks on Bing. I just ignored it. I don't think it's normal. So, they do give penalties but are not aggressive like Google. If SEOs badmouth about them, they might loose whatever traffic they already have.

They need not have to punish individual sites. They just need to update their algorithm so that it differentiates between quality content and spam.
