Spam email lawsuit

Hey guys,

I recently had one of my accounts terminated. Somebody sued the advertiser and ad network for spam emails with my link in them. The relationship manager is pissed at me and they have my real information.

Help? Has anyone ever dealt with this? Could I have legal repercussions also?

The advertiser is likely to forward (pass) your own data to them so they are left out alone, don['t trying to scare you. Often these go away once content (data) is taken down, they won't waste time suing.

It isn't for copyright, but concerning emails I may have sent out. They claim to be entitled to $1000 per email under California law. I'm in the US, but maybe they won't consider me worth the effort?

Yes, they terminated my account and told me I could be in trouble. They were just CPA affiliate emails but apparently they broke California law.

But that happen every day they look for this to ban accounts in general .....

What all the sueing talk and shit is that even real.

I am sure your get a law letter not them saying stuff if it was that real.

Thousands place links everywere and got country rules, sounds like a threat to scare you.

And who is the complaint from? An ISP (e.g: xMission) ? Or just some unknown individual?

If the complaint is from an ISP, you're definitely fucked. If it is from just some unknown individual you can relax a little as they're just throwing a fit but won't go further than that.

Do note there's unsolicited email spam laws... like the can-spam act, etc. Certain affiliate networks had gotten into trouble with ISPs because of affiliates sending out email spams... they were brought to court and things got really ugly. It is so bad that every affiliate network has a client contract now that holds affiliates liable for any legal repercussion if they did anything bad (e.g: spam, false advertising, trouble with the FDA or FTC, etc)

Well that the ad Network problam, not yours, unless the ad Network want to sue you to compensate them.

I don't particularly want to say as the lawsuit may become public information. Let's just say you'd recognize the name of the network.

The suit is from an individual, but I looked up their name and they have a history of filing these. I'm afraid I'm gonna end up on the hook for all the damages. The advertiser and network for sure both don't want to take responsibility.

Sucks OP, no idea how to help and cannot offer any advice besides never put your real name on anything. Use burner banks, names, etc for anything and everything. Will inevitably be some breakage but better than a 5 figure lawsuit, or any lawsuit for that matter. Good luck brother.

Depends, if the content you sent out was also violating CA laws, then could be trouble
