How to Set Up a LLC in USA for Non-Residents + US Bank Account (all sources shared)

I have Instagram account with more than 400k USA followers. I need company for stripe to set up shopify.

I don't think that my revenue will be a big.

Is It bad idea to register LTD in UK?

This thread is so hard to understand what is right, so I will ask again.

I’m non US resident and I’m living outside of US.

I decide to register LLC for dropshipping on incfile.com in Delaware state
Package costs $339
It includes IRS form 2553

Delaware is free from taxes

After all of these do I need accountant who will help me to fill 5472 and 1120 forms?

No, no need for an accountant, the most difficult part will be the banking introduction !

I believe c corporation bank accounts are a bit different, but you have to pay your 21% tax in the US with one, so you aren't actually avoiding tax and you DO NOT own the account or the money with a c corp. The company does, and the company is a US entity, paying tax in the US, until such times as you take a dividend to your personal account.

But with an LLC this isn't the case, so the banks tend to share more information with your home country. Depends on the bank, but you never know. You can just assume that your home country will very likely discover you own a US bank account and will ask you about it. They won't know about the LLC, but they'll know you have an undeclared foreign bank account, which is enough to trigger an investigation.
So, to be really safe, the bank account must be in the name of the LLC and not an account in your name?
I did not understand well ?

You would never have an account in your name.. That wouldn't be a business account. It would be a personal account. There's no point having an LLC if your bank account is in your name.

But even with an account in the name of the LLC, banks will still notify the country of the account holder. They don't for C corporation bank accounts, because it's not a pass through entity. It's an actual taxable US entity.

Are you sure, Wyoming is anonymous , or am i wrong?

On seperate note does anyone know, what constitutes a write off in US?

Many who work with SEO uses paypal invoices which often has '' Order'' and name of bussines .
Others send Payoneer payment links,.

Does these kind of '' invoices'' are enough for to be write offs and can be paid from US company acc?

Tried Stripe?

Paypal asked for personal SSN to verify the account. I dont think will last long as im not a US citizen.

Stripe works fine.

Great thread. Got all my questions answered.

But one,

Do I need to use any VPN to log in to my Paypal business account?

PayPal is asking for form W9 from me. How do I get one? Or I just download and fill the form myself with physical signature?

Please clarify with amazon: are you supposed to issue a W9 to one of your customers to whom you paid more than 600 USD in a tax year ? That does not make a lot of sense for dropshipping since your suppliers are outside the US and do not pay US taxes. Of course you can issue a W9 but it does not make any sense.

If Amazon used an Amazon warehouse in the US your "disregarded" LLC becomes tax liable in the US.

I am not sure what you want to say exactly.
1) disregarded entity
An LLC is disregarded as an entity for tax purposes if you select to treat it as a partnership.
If it is treated as a partnership, then the partners have to pay taxes on the LLC's profit.
That the partners pay the taxes is always the case in a partnership and independent of any warehouses they might have.

2) warehouses
Warehouses typically do not establish a place of business (subject you to tax liability in a foreign country).
To find out whether your entity has a US place of business you can look at the double taxation treaties
which in the case of the US you can find here:
https://www.irs.gov/businesses/international-businesses/united-states-income-tax-treaties-a-to-z
Just picking a random country like France, the double taxation treaty provides:
Notwithstanding the preceding provisions of this Article, the term "permanent establishment" shall be deemed not to include:
(a) the use of facilities solely for the purpose of storage, display, or delivery ofgoods or merchandise belonging to the enterprise;

It is some time ago, that I did taxes, so I am very interested in feedback, i.e. whether something has changed.
