I just read http://www.blackhatworld.com/blackhat-seo/banned-users/147260-theslugclub-perm-ban-requested.html .
Even though BHW is already full with people I think it's a shame that we lost people like that. I would suggest that those banned should have the right to ask for some open trial. The mod here is already far more reasonable than the mods at other places. I am not questioning their judgment. It's just that it helps us mere mortals to understand what broke the rule and what doesn't. For example, someone complained about an autoblog seller. Another jokingly said that they should buy from someone producing autoblog automatically. He thought because no where in the thread he mentioned that he was selling automatically created autoblog, then it's okay. The thing is his sigs said that there were some experimental packages related to that and deep in his BST there was a post where he mentioned that he can automate autoblog creation. Also another person that found out about it whimsically complain that he is pimping his product.
So, he got banned for 1 month and he losted his BST and sigs (because that's where the selling is?). The lost of BST is quite a pain though. There are plenty of customers testimonies, and SEO advices there :(
What I regretted is, he didn't know before hand, and still doesn't know where the "line" is. He didn't say people should buy from him. He didn't mention he was selling. He recommended other sellers instead to make that clear.
So all this time I feel like I am tiptoeing carefully and risk of suddenly boom got hit by lightning for who knows what. I seriously considering to stop selling anything on BHW or maybe stop posting anything and keep BHW on strictly business mode. I'll let my apprentices do the selling which works quite well. They seems to have more common sense than me to sense danger.
The risk is just too big for every post if you don't know the rules. To me, and many others like me, it's tricky to know the rules if it's not detailed or there is no open court cases. Having open trials and court cases, for example, will help us see samples of what's "wrong". Another issue is the penalty.
Ban and Permanent ban will not deter fraudsters and spammers. They just created a different account and start over again. Perm ban will deter a lot of people. Those with reputation, posts a lot, and has significant business will be hurt the most from perm ban. I don't think that serves BHW interest to deter "the good guy" than the bad guy. It's like jail. Doesn't deter thieves burglars and robbers, but deter businessmen and programmers.
A ban or perm ban for me, for example, means I would lost around $1k-$2k a month. It's no longer a lion share of my biz because I can spend the time to work for my own systems instead, but would still bite. I suggested an optional $50-$100 fine rather than a ban for people that posts a lot and have problems. That would deter fraudsters spammers and "significant" members equally. Those who think BHW is worthy won't mind paying and BHW can use more money anyway. Otherwise, they'll just think about what they do during their 1 month ban.
