Someone Is Copying My Website and Getting Ranked!

I designed software templates and sell on the internet. (Private Label) I then found a person bought my software and starting selling my design on their website.

Now I see that they are ranking just below me because they are using my page titles and keywords on their website. I am completely fed up with this loser and I really don't see why Google has indexed them to begin with.

Any help or post would be greatly appreciated!
 
-contact him and say him to stop that.
-contact his hosting and say them he leech your work
-contact google if he use adsense (close an adsense account is not good for him)
-Contact his paiement provider (allopass or another)

if with that you don't arrive to stop his job, make a big big blast of BL on spammed digg/forum and his site will be black listed by google (but after 2/3 month he will be back with many BL and maybe better position)

Just keep getting backlinks so he doesnt outranks you- IF you will do something to him that will only show that you are DAMN PUSSY who can't take a competition!
 
prove that he is selling your stuff as his own without permission, contact his hosting provider and get them stop his acct. get the jackass's name and number, impersonate an attorney and call him and email him telling him to cease the sale of your property or he will be served with legal papers. i had somebody design a site for me a few years back, looked great. found out later that this site was copied and that is exactly what happened to me. i just hit the stop button on the server. no biggie. oh, and then i smacked the hell, literally, out of the guy who took my money for the bogus job and got my money back.

He is smarter than you. Try to learn from him how exactly we should make money. Don't complain about him. Prove yourself smarter and make another 9 sales page. Dominate the 1st page with all of them. I think you got the point.

Right on man!! OP, you say that, he is Ranking just below you, so see to it that you hold the Number 1 Spot. For that, keep building more and more Backlinks through your Keywords in Anchor Texts.

Also, just E-Mail that Pussy saying that, you know the Hosting guys and will complain to them which will result in Banning of his account. This works most of them times, if it doesn't, then just Lie your Ass off that, your dad is a Renowned Attorney and you will Sue him to the core :D

Good luck with that one. I have a friend who steals templates and resells them as his own and its been his primary business for over 5 years now.... but then again, not too many people actually follow up on their threats either...
 
Try threatening some ripoff artist in India or China - or anywhere outside of the US - with legal action.

It'll cost you $200-$1000 with a lawyer to find out that you're screwed, copyright cannot be enforced outside of North America (and just barely INSIDE NA), 2checkout, etc. doesn't give a crap, and you're out of luck.

If you're REALLY lucky, they didn't copy the source on everything and install it on their own server, they took the code still linked to your graphics. (That happened to me several times, the lazy bastards.)

What you do then is change the filenames of your own graphics and put some REALLY NASTY GRAPHICS up using the original filenames. I mean really, really, really nasty ugly sickening stuff.

Not a permanent solution, but the electronic equivalent of putting a huge flaming bag of dog poop on their porch and ringing the bell. :D

PS. One idiot asshole actually emailed me and asked why I'd changed the graphics to such horrible stuff! Really!

lol not much you can do my friend. chances are he's around here somewhere reading this very thread. and if you xrumer his ass, what makes you think he wont turn around and do the same to you. you have way more to lose than he does. like someone said, continue your BL efforts to make sure he doesn't out rank you..:D

I like this idea about the letter, i'm sure you can google a cease and desist letter, pretending to be a lawyer

That may have been poorly worded but it is somewhat true. Start thinking of him as your friend because you get to learn from him for free. If he's copying you but marketing better, you will always have the upper hand. Simply clone his approach to marketing and then improve upon it. He can't improve on your business, but you can stay one step ahead of his marketing program.
 
set up a free blog claiming to be an Islamic fundamentalist, environmental activist,animal rights campaigner...discussing ..er .......er projects involving US politicians.......link to his site stating he is a member who supports you financially ......

Then email fbi about your phoney site.......

Sit back and wait for his site to disappear and for him to be water boarded lol

I see the words Private Label, and wonder if this guy thinks he is allowed to sell your design.

Check your own terms, to ensure that your designs are not covered in the private labeling. Make the text big and bold so nobody else does the same.
 
I would send him a C&D order. About 8 out of 10 times that works.

Get an actual lawyer.

The amount you win in a lawsuit will far outweigh the cost of a lawyer. Theft of copyright information, loss of business, intellectual property theft, infringing on copyright terms, etc.

Make an example out of him.

Idiots crack me up.

Back in the day when I used to sell on eBay (before they required everyone to use PayPal and so I quit selling on eBay), I sold a proprietary product and used my own images and everything, and from time to time a few people stole my auction site layout and all my graphics and everything. I'd email them and tell them to knock it off. Of course, this was back in the 90s when if you emailed eBay for customer support they would actually help you out.

Anyway, one day this guy (a competitor who was copying me) emails me (this was back in the day when eBay provided email addresses) and has the gaul to say "check out this guy [inserts link], he copied both of us!"

I was thinking "so basically what you're saying is he's copying me, since your auction is a direct copy of mine, too," but I decided to pretend like I wasn't aware of this guy copying me so I said "wow, thanks for bringing that to my attention. I needed to give my lawyers something to do."

The next day the other guy's auction was removed.

The seller emails me again and said "holy shit!" and then I noticed that he had closed all his auctions, too.

I'm all for threatening legal action, but I'm also all for backing it up.

Copyright and intellectual property is serious business. There are people who make 8 figures a year defending it in court. Probably 95 out of 100 people won't actually do anything, but those other 5 will ruin your life, and you never know who you're dealing with, so I always recommend not stealing other people's work.

But I'm also a nice guy. I would always ask someone politely to stop before actually siccing lawyers on them. It's possible it's just some teenager in his parents' basement who doesn't know that he's breaking the law.

Step 1 - ask nicely

Step 2 - Cease and desist

Step 3 - Ruin life

edit - feel free expedite Step 2 if you get bullshit attitude back in response to Step 1. The correct response is "oh, sorry, I'll stop stealing your stuff and remove/delete/whatever it." The correct response is NOT "make me, asshole" or anything else along those lines :D
