Hly crap. Look at the dirt on this guy. The feds have looked into him apparenty. Assuming it's actually him??
He sounds pretty crafty. I know he got banned from other forum for trying to hack them but didn't think it was this big.
The mortgage company I previously worked for was "hit" by Mr. Swanberg in 2006. He basically "extorted" $2500 out of us by threatening to sue over a DoNotCall violation, but would take the $2500 and go away if we didn't want to go to court. Despite the fact that we knew the suit was without merit, we paid the $2500 because legal fees would have been significantly more. And that is how he usually stings his victims.
What drove me crazy was the way he went about trapping one of our branch managers. He called the business number, which was forwarded to the branch managers cell phone and left a message. The message was "test, test, test, my telephone number is xxx-xxx-xxxx" When the branch manager called back, Swanberg accused the manager of violating the DoNotCall laws because Swanberg's number was on the DNC list. The manager protested saying he was returning Mr. Swanberg's call. Swanberg, said his call was a test of our companies' DoNotCall procedures, and that the managers return call was obviously a solicitation for business.
Well, our manager eventually lost his cool after several minutes of arguing and called Swanberg an "ass" among other things. Now get this! Swanberg was recording the whole conversation. After a few days our manager received a copy of the recorded call, a one inch stack of legal documents showing previous lawsuits and letters from others who paid him off. When our company heard the recording we considered the bad press of our manager losing his temper and decided to pay him off rather than fight. We even bought his book to learn more about his tactics. He claimed to sit at home for days with multiple phone lines in his apartment, waiting for call backs, and opportunities to nail companies. Once we read how he had been doing this for years with some success, we caved in. Swanberg signed a document agreeing to never call us again with one of his "tests", and took his $2500.
Let's hope this guy has finally been stopped. But it doesn't stop someone else from trying his tactics in the future. My advice is train your people properly when it comes to DoNotCall. Don't take chances with phone lists you purchase from resellers unless they guarantee compliance.
