Google's DCMA system acts preemptively for the claimer. This has historically been a very black hat trick like Negative SEO and that.

But you can just appeal with the right information and it will go down. But obviously, the damage is done and it cannot be repaired. Unless you try to move a legal action against the claimer for being a fraud, which most of the time won't be worthy (unless you are a huge site that has loss a couple of dozen thousand dollars during the Google's downtime)
