Ebay - digital activation keys legality

So as you all know there are quite a lot of activation keys going around Ebay (Windows 7 Pro, Office Home and student ).

These keys are OEM, which means they are taken off of old computers/motherboards and then resold ( at least that's what I know)

Now I have a couple of questions :

1.Do I have to be registered Microsoft Re-seller in order to sell those items without being taken down? (One of my listings was taken down for "Copyright Violation - Software licensing" while others are still doing fine )

2. Why are some sellers allowed to sell these keys while I got my listing shut down ?

It would mean a lot to me if someone that has experience in this field would shine some light into it because Iv'e started doing this and I really love it!

I’m pretty sure that you are not allowed to sell MS licences like that.

With the refurbisher program you can get cheap licences and add them to a refurbished machine but you can’t sell them on their own.

To be honest though I don’t know how some ebay sellers get around that.

Most big sellers are registered in Germany, ( Can't link to a seller ...)

It might be that its related to the fact that they are registered in Germany and they have some different laws for OEM reselling

Im not sure why they are mostly german sellers, but they still are taken down a lot.

Just let me tell you, man, those are not german sellers those are drop shipper most of them are germans because they made specifically a German account because german eBay account is better for selling digital products

Most of them don't sell I mean resell OEM licenses but legit retail Keys
