Selling branded items on Ebay

So there's a brand of items from the skin care niche
that sells very very well on Ebay. ( and a lot of people are selling it )
Now I sent an email to the company asking for their permission to resell their items ( While I'm selling their items ) and they declined and stated they will take legal action if I do.

*Now I mentioned to them that their items are CURRENTLY being sold on Ebay and they can remove them with the VERO program ( It's literally a couple of emails to remove those listings), but I guess I fell on an intern that's working there because she just continued threatening me.

*And I understand that perhaps its actually worth it for them to stay in this position of not taking any action because they are getting more sales on Ebay this way as well as the fact that they don't have to pay any fees.

Now my question is this : Is it possible for a company to take legal action against an individual if they're selling on ebay? Is the fact that they declined my question has any legal obligation towards me ?

I think the worst can happen is account limitation based on VeRO report (verified rights owner program). Nobody will sue you because of reselling some stuff, that's ridiculous :)
 
What i suggest is that you go to alibaba and make your research on what you want to buy and after you make your decision talk to the manfracturer and make a deal with them to sell branded items, you could be paying a little bit more but it's worth it,light amount of money.
 
Why are you seeking permission? Do one of the following:

1. Find a distributor that sells that brand and apply for an account.
2. If no distributor, apply to brand for a wholesale account.

if you go stealth then legal action wouldnt be an issue. Usually they jsut contact ebay to remove infringing content. You should be fine unless you seriosuly abuse this policy. Spread risk across sevral accounts
 
Update: I sold a couple more of their items and after those sales
I've deleted the listings I decided it's not worth my Ebay account.
