Our team has done a Case study based on this case
We had a website which we de-indexed from Google. (this website was 3 months old and ranked for many keywords)
We used it's Content and went live with another website.
The website got indexed and got ranked for many keywords in Just 1 month.
After 1 month we re indexed the OLD WEBSITE.
The new website on which we had used the duplicate content got penalized and lost it's rank and finally de-indexed.
Now, you can make out what would potentially happen. I think, as long as your competitor doesn't try to re index the website you are good to go.
