Can I sell a site with "downloaded" theme?

Hi, can I sell my site on Flippa with a premium theme that I downloaded from the internet and not bought?

At the moment, I can't pay for those ThemeForest themes so I have to rely on downloaded premium themes. So, is it okay if I have a site around a premium theme that is downloaded and not actually bought and is perfectly functional?

Also, where can I get multi-purpose responsive themes in the directory/listing category for free?
 
LoL, depends? maybe try listing it.
Worried what to tell when people ask me if they get a license for the theme and also thinking whether flippa can ban me or not?

Why not just list the site and say it does come with a licensed theme, then, when it sells, buy the license? You can also factor that cost into the price.

Another thing, suppose a buyer pays via escrow or paypal, do I get the money instantly into my bank or there will be hold of any kind?

There will be a hold. But with a simple search on google.com or a look on escrow.com you would have found this information in literally 10 sec.
They explain the process pretty damn good, and if not, contact their support.

If the buyer buys per PayPal, there shouldn´t be a hold.
 
You can sell them, but expect repercussion should the themes be hacked/contain backdoors.

I've never sold anthing on Flippa, but I believe you can disable Flippa Escrow and only accept PayPal as a payment gateway, so you can make sure you have access to the funds immediately to buy a proper license.

Also, just makes sure you back up the site before you uninstall the nulled version and install the paid version just in case something goes wrong during the switch over.

Getting the money immediately from PayPal all depends on the type of PayPal account he is using and the country the PayPal account is domiciled
