Problem with User Hendrikkk

Dear Community,

Have a huge problem with the user @hendrikkk .

I wanted to work with him for one month for some social media and fb group posting activities. I paid him around 300usd for a month. Shortly after i paid it to him, i found a much better freelancer. I complaint even before he had the money on his bank account and before we started to work, and apologized for the circumstances, but i am not more able to work with him. Until now he denies to give me my 300usd back. I can understand him on one side, but i am a supporter of honesty and honest business. maybe we can solve our problem here.

Everything started a few months ago. i was asking on bhw for a freelancer, and he gave me his skype ID:




after this is started to work with an other freelancer, and had no contact to him for a few months. Then i was looking for a new one and started to talking to him on skype again:






here i paid the invoice with my bank account: it was 278€. for one month. But shortly after i paid it, i found a much better freelancer. so i complaint immediatly:





But we denied to transfer me the money back, we did not even start to work, we did nothing, so i apologized for the circumstanced and told him, that he should transfer the money:

Please help me, i dont need his service anymore, and 278€ are a lot of money. I have my freelancer already. I can understand him on one way. but i support honesty and honest business.

According to EU Law, this is an online service. There is a right of a withdrawal of 14 days. i complainted 1 day after the payment.

it is true that i am not returning the money. this is because of the fact that well before you paid i have said that the payments are non refundable and you agreed to it. i am more then willing to start working for you as we agreed. i dont really know what else to say if you require anything from me then please ask so i can provide the info

Also, judging from the Skype chat you did not even receive the money from him when he asked for a refund and didn't start working for at least 2 days after he sent it.

i had checked the wrong account when he said he wanted a refund. i already had the money when he wanted a refund in private i am willing to show you proof with time and date when i received it. also i started preparating the service. he did not already deliver all the necessary things for me to start the service but i already prepared so that onces he gave all the necessary stuff i could start inmidiatly, I have added the screenshot, This is what it says on the invoice.

i said i was unreachable because of a trip, which i was because the place where i was had really shitty wifi so communication was really hard. however i could prepare the service

Your invoice says once the service is started there is no refund but you stated you did not start the service.

I started the services from my end but because he didnt deliver the things needed i couldnt set in motion. I did start working on it so the transaction is non refundable he agreed to this by paying

no i do not owe him the refund because as i said i started with the service. i might have said things that said different but i am sorry english is not my first language so i can not express me perfect in english. i have stated multiple times that i have started preparing for the service so that i have started working on it. No, the ruling here on BHW is that you did not start it as you stated it twice and in your ToS you say, "no refund once you start", not once you start preparing.
