Usually they will toss any big mean business house into the Atlantic or Pacific (depending which part of the continent the business is on) but in your case they may just toss the coin and see which side the coin falls and then decide.

Seriously again, don't lose sleep over it. If you're afraid (anyone can be) then try things a bit differently, modestly, and a bit more nicely.

Forgot to mention, if you are in US, then why don't you try to take a job some other place and be as far away from those xx... be in china for example, you may have more opportunities to safely go after them again.

IMHO, take a good legal advice and do whatever the lawyer-god tells you.
Take care and sleep well. I think they will lose the goodwill of lots of people if they try to come after people like you who were just "trying" to make a "living"... they should really go after those hackers rather than giving poor IMers the dog-hunt treatment. Bad Karma on their part by not going after the real bad-a$$ sharks present in plenty on their site.
