Will google ban me for this scheme

due to to the interlinking of all your sites, there is a high risk indeed to get caught.
 
Sounds very good but just lower the number of interlinked sites in tier 2 make 3 or 4 interlinked maximum. I personally use 3 and never got a problem since Panda 2011.
 
It all honestly depends what kind of site Site 1 is. If you do the Purloined Letter approach and make it clear to google then you would be okay. Say for exampel Site 1 is an SEO website, and it is linked to all of the other wbesites with something liek "SEO by xxxx.com", then naturally of course the backlinsk for sites 2-9 will be similar if they were all your 'clients'.

Otherwise, I would suggest you vary to backlinks to Site 2-9 since they are all too similar. Look at Linkpushing's diagram for example and see how varied it gets per second tier properties, try mixing it up in regards to ratio of web 2.0s and directories for each site.
