Why haven't this site faced duplicate content panelty. It's using default theme content.

I searched for "agencia seo" in Google, and on the 7th position is
AgenciaSEO.com I understand that it's an exact match domain so it could be benefint the website. However, how come it hasn't been penalized for duplicate content?

The website is using default content that came with "SEO WP" theme on theme forest. It just changed the theme logo to it's logo. Now I've seen many website using the default content, but they never rank this high. And as hundred of website are already using the same content, shouldn't this site be penalized for duplciate content?

Just to make sure, you know that duplicate content isn't about the theme, right?

That site is in Spanish, I don't know why you said that the site is using theme's default content while the demo on theme forest is in English.
Maybe they have spanish version on the theme, but the one Google know is the English version.

Translating it from English doesn't mean duplicate content. I've seen translated content rank before, usually not as high as original content, but if translated properly, it could rank.

If the guy knows how to rank translated or even duplicated content as high as this, he definitely knows SEO, maybe not gray one, but he definitely knows.

Totally agreed. Translated content works well if you can organize it properly. But recent Google update seems like working on it. I saw a few websites down like hell because of using the translated content.
 
Oh, it seems my browser autotranslated the content on the website.
