Blackhat usually means breaking terms and conditions (but not the law) to exploit a weakness in any system to maximise results/profit.

Breaking rules of Google Play or Appstore. For example, if they not allow for ads outside application, you show them anyway but you need to hide from Google algorithms.
It's not breaking law, blackhat apps are not malware.
