That is the contract of the advertising account rental companies, not Facebook. Most account rental companies have such contracts.

maybe they are talking about your account threshold % split amount, you can consider this if your campaign is still performing well in the new account

my client also do the same but it will not last long, a good ad account will lead you good results, refund will affect your campaign will stop at that account

yes, they can do it. Refund from FB
 
I see it still exists but at 40% you should reconsider, it seems like a scam and can easily get your account locked.

This is illegal and really bad for the account. Always get 792 restricted.
 
Sounds shady, if it sounds too good to be true and there's no clear contract or transparency, it's best to walk away.
