What content is legal to scrape?

I'm a developer looking into scraping some content off the web and creating new content based off of that . However i've come across a lot of stuff being copyrighted under the creative common license - i.e legal to scrape as long as I reference the source and dont profit off it.

Is there something I need to look out for to find content that is scrapable that is legal ? Like a certain license?

What happens if i do it anyway? Do they have to request a DMCA first, or can they go straight to suing?
