What about copyrights?

First of all I'm not sure where to post this so please forgive me if I am in the wrong section, which I probably am.

I'm getting started in SEO with Moz and ads and everything, testing out things around like a newbie has to do. However, my niche concerns a Nintendo thing. I'm basically selling Nintendo X products on my own website. Before I start throwing away money at this, I'd like to ask you; What are the chances Nintendo is going to bash my head in by throwing lawyers at me?

as poster said above, don't use brand name in the logo or domain. If you are legit and not selling pirate games,hacks or stolen then you'll be ok, otherwise sites like Amazon, Ebay or Game wouldn't have products to sell. Using images to sell their products and using descriptions that do not mislead will mean you are ok

Why would Nintendo bash you if you are making money for them.That would be shooting themselves in the foot.

I don't know man, I was just afraid to see all my efforts be in vain because of such a silly thing. I preferred to ask before I put more hours/money into this. This relieves me a lot because the worrying was a drawback.

I forgot to mention I was selling non-nintendo made products. I did not make them but I'm reselling them from Aliexpress. Does that change something? I heard fanart was illegal, as stupid as this can be.

EDIT: Could it be considered counterfeit even if not claiming to be original? Could I get charged even if I never ''aquired'' the products myself and acted like a middle man?

So what you want to say is that, you want to sell China made copies of nitendo products! I dont think its a great idea and they will strike bad if any one of your customers went to them for any kind of claim

They're not exactly ''copies''

For example, one of the products is plushies representing the game's characters. Let's say it's a Mario Plush. It's not claiming to be an official Mario plush made by Nintendo - but it's still a Mario Plush not made by Nintendo.

Basically the maker (China supplier) doesn't own the legal rights to produce and sell them here in USA (but in China there's no copyrights laws so they don't care). I am not making those products neither owning them, but I am ''listing'' and acting as a middle man to provide them to potential buyers.

Does the responsibilities then fall on me? Am I considered a seller even if I state this?

I searched all over Google yesterday and I've found nothing! There's no answers to this yet. I think I could potentially be liable for encouraging this type of *criminal* activity.

What are the potential consequences? A strike or downright a suing process?

Any lawyer in the place lol?

YES. It was trademarking offense.

NO, the company wouldn't sue you.

YES, they could ask you to stop, then you would just oblige without consequences.

That's usually how it goes! I just wouldn't bet all my income on this source.
