Watermarking Pictures

Hey Guys!

Quick Question:
I have a lifestyle account and I cool pictures I find from Instagram and basically repost them with my own Description and Tags. I always make sure to acknowledge the original posters by saying "Via @blahblahblah" and I tag them in the picture. I know that's allowed but I take it a step further by using PicLab HD (the best editor ever!) to add my brands logo as a watermark and sometimes add an effect to the picture to make it look better. Is that ethical/legal if I am tagging the photographers and posters? Some photographers I DM and tell them I will be doing this and to message me if there's a problem.

Were they okay that you were going to do this when you DM'ed them?

Yeah, usually I got no response so I stopped DMing people. One guy was totally cool with it though.

If the authors want to they can screw you. Basically on the Internet the fair use clause is "stretched" because you end up sending traffic and branding to the photo author, so it's a bit more flexible online. Also, suing people makes you look very bad online(see Barbara Streisand).

But if you derive art from the photo, they can sue you and request a share of your profits.

On the website that I am creating, I will have a legal page stating that we claim no rights to the pictures that we post and that the credit goes to the original posters. I will also state that we water mark our photos simply to keep people from reposting what we post.

Will that add some protection to what you are saying?

Hi i would recommend you to buy this app in Play store. You can download the free version for watermark only text. Or buy it and you watermark with own logo och any picture. I cant post the link but search androidvilla.addwatermark in Google play.
