Using other peoples videos on youtube

Hey guys. A while back I made a channel where I was going to upload stream fail compilations to youtube using other peoples clips. I uploaded 2 and both were claimed by copyright in a day or two.

What I want to know is how the other streamer fail compilation channels get away with it. Surely they don't ask each and every individual streamer for their permission before using their clips. There are too many channels and too many streamers coming out every day for that to be the case.

So is there a way of using other streaming channels short clips without getting copyright claimed on them?

One last thing. On the 2 videos I uploaded, some of the clips in it were over 30 seconds and I forgot to credit them in the actual video which was about 10 minutes long ( I did credit them in the description). Would keeping the clips to under 30 seconds and crediting them help with this? Thanks.

You should be OK using videos with Creative Commons license. Try this filter when searching for videos on YT.

I am not sure how they get banned but I guess maybe they ask permission from all of that Youtubers then compile their video? just an idea I am not sure about my answer!
 
This is how you can legally use other people video to promote your stuff on youtube if, you are not prepare to use own video.

For instance you would like to duplicate a youtube video which talk about how to become rich, you can search on youtube for a related video's on this subject and use video conversion tool to convert & store them on pc.

Now, you can import converted video to windows movie maker or by using other video editing tool to do the finish-up work

splitting & cutting some part of this video. In order to make it as short as possible

Now, Create comparism tittle i.e "Top 5 millionaires habit that most poor lack"

Insert own tittle,foto at the begining and gradually include a short slide of the converted video as reference in btw your speech,foto....ecc

In this way's there will be no need asking for permission from the rightful owner neither will you violate youtube copyright since, you've created this video as a reference for the purpose of education or entertainment.

They will get banned sooner or later. Matter of time.
 
speaking of uploading other peoples videos.....someone has done that with one of my videos. now they have almost 4 million views on MY video. they have done nothing to alter it at all. its just a direct re-upload. all of their videos are like that. this video has been reuploaded by probably 50 other accounts and every time i had no problem getting the video down. now youtube wont do it, saying i need to supply other info, etc. so, i have $20 in paypal to anyone who can get it removed for me
 
Some of them ask the creator of the video if its ok to use it or not. If your compilation goes viral, the creator of the video will also benefit from it.

The extreme black hat option (where you could maybe get legally sued) is, to take the videos and just changes things about them (Audio, slightly adding some effect overlay over them) to make it hard - impossible for YouTube to detect its a ripped video.

You can use copyright videos without the owner's permission ONLY if it's falls under the description of "fair use"

do a lot of editing, mixing then publish,. if you do this, 95% you wont receive copyright infringement. or atleast it will take lot of time to tke your video down, but by then you have reached your goal :-D
 
I had similar problems with my own channel.

If your doing compilations chances are the streamer/youtuber wont know there in your video and its being detected automatically by the streamer/youtuber's partner. If this is the case than use 20secs or less of the clip and you will be able to get away with it.

If they are claiming the videos manually than the only thing you can do is remove the streamer from future clips or dispute the claim and risk getting your channel taken down. I think its pretty obvious what the best choice is if your constantly getting claimed.
 
Technically when you take someone elses video and mix it up or make a "compilation" it falls under the fair use law.
This is how news channels are able to take stock video and photos and use them without getting copyright issues because it falls under fair use law.
it also applies to you tube videos as well, but there is a grey area in this because people take advantage of it to blatantly steal others videos.

So to answer your questin if you are taking clips and making compilation videos then you 1, are going to get copyright claims of course but 2. you will have to fight these claims and reply with the proper verbage to fight these claims.

Had a friend who had a fail channel while back, they successfully fought each and every claim on their channel ONLy because they properly chopped up the videos and make a real compilation and made it unique not just a straight rip off. So you need to read up on fair use within youtube law and you should be okay moving forward..
